If there is a designated right of way through that backyard then yes the franchise does give the cable company the right to run their cables there (not always for free) although I wouldn't call the franchise fee a rental charge. If there is a public street or road at the front of or through your property there is a very good chance you are already paying property taxes on at least part of its right of way.
