I believe part of Verizon's deal to acquire certain spectrum that they had to leave the iPhone unlocked, for the same reason that Verizon can't charge for tethering.
Prior to that, Verizon would actually lock phones that had been previously unlocked when the phone was added to Verizon's network.
Also just because the iPhone 5 is unlocked, doesn't mean people who bought a contract can switch without paying the ETF.
