I'll start with these:

1.) The switch isn't in the proper diagonal position (45 degree angle would look better).
2.) They missed a few spots on the switch that aren't covered with fresh paint (another major aesthetics violations).
3.) The switch doesn't stick out far enough to get good access to the contact screws (got to have a place to hold the body of the switch while toggling the handle).

I'd say gang box is way too deep in with two layers of drywall.

But of course, the real reason is because the homeowner ran out of space in the box and needed a deeper box to stuff even more wires in. This is a dual gang box after all. It can take another switch.

That isn't drywall unless they came out with a wood grain pattern. That is an ugly looking spaghetti mess too..

It depends. What version of the NEC applies and when was it installed?

Things might not be as bad as it looks to fix. It looks like the box is held in place by a screw or two in washers along the left hand side. Remove the screws, pull the box flush, resecure. Hopefully there's enough slack in the wire.
