I get every bit of the 10/1 service I pay for. The slow speeds are almost certainly a result of packet loss.
It's normal for the occasional packet to be lost, but it should not be at any measurable level. That you're seeing upward of 3-5%+ is problematic and I would recommend calling support to have the connection evaluated.
I'm on a 20/2 tier, and see around 16-17 down and 2/2.5 up. That's through my Linksys router to BHN's speedtest site.
I'd trade off 5 down if I could have the 5 up... LOL
