Teksavvy seeking adjournment....... |

Saying that only 10% of the affected have received notice.
So, the links in that email? |
|
UK_Dave |
teksavvy uncovered errors in its approach to sending notices due to short time frame. 42 people so far have gotten notices who shouldn't |
|

Justice has only just received cippic letter..... |

edit: sorry Dave, I'll let you handle it. |

Voltage arguing cippic has no standing. Procedural issues. |

Voltage says they contacted teksavvy on November 1st |

they did embed a "malicious link" in their email @mgeist: @pandersen: #teksavvy has only gotten confirmation that 10% have received notice |
|
UK_Dave |
#teksavvy rebuts evidence issue notes that some issues only came to light this morning. No time to swear an affidavit. |
|
UK_Dave |
Voltage notes that no affidavit has been filed on evidence |
|

#teksavvy disputes November 1st date noting that only drafts were provided. Actual motion came early December. |

"Voltage is concerned that a delay allows those titles remain available online and that is what their client wishes to stop."
As if stopping only TekSavvy customers will stop p2p availability.. Sorry for the interruption, just had to vent. |

Voltage notes this motion is precursor to litigation against individuals who have infringed. |

#teksavvy arguing against voltage of prejudice delay noting their documents only talk about infringement at a specific point not ongoing. |

Voltage counters they can't launch injunction unless they know who the individuals are. #teksavvy |

Voltage suggests that if court wishes the motion could continue on those who have gotten notice. Deal with errors later |

IMPORTANT:
Judge has adjourned for five minutes or however long it takes to get his thoughts as he considers the cippic letter he just got |

I really have high doubts that the users are still sharing the alleged files! This is nonsense. |

42 subscribers reported in error. 92 not reported in error to be sent soon. Those infusion emails? They've been using them to track how many people have received their notices. Which is less than 10% of affected subs.
Judge refused to hear cippic, as they didn't move to intervene, but just write a letter. Judge will read letter again before decision to delay to jan.
Judge making decision now, hense able to tweet. |

It goes to show how they want the court to remain ignorant about the nature of Bittorrenting. |
