Ultimately we all want ISPs that stay out of the way of what we want to do, so expecting them to step in front of the consequences when they come back looks hypocritical to me.

When you get fixed content from a provider like Bell or Rogers, the legalities of that content are on them. When we use the 'dumb pipe' to go and get stuff on your own accord, that is on us. It really can't work any other way.

Analogy time: when you use a hotel room you expect that you can do most anything you want in there. You don't want the hotel to know or care what you are doing. If a crime occurs the cops are going to want to know who was in there. The hotel bears no responsibility to defend the customer or protect their identity in the face of a court order. They were free to do whatever they wanted in there and the consequences are on them.

Except it isn't the cops that want your information, it's a private company that is just looking for your information so they can blackmail you like they've blackmailed thousands of other people. I would hope and expect the hotel to say: "Hey, this isn't right. You can't persecute our customers like this. Mr Judge, take a look at what these people have done in the past, look at this other information here which raises some legitimate questions about what they're asking you to release, and understand that the consequences of releasing this information for our customers will be potentially devastating. Are you sure these guys are legit?"
