I'm not sure what you're going on about here. I don't see anything sneaky. The provision in the text (it's not even a bill yet) that you highlighted requires the capping ISP to provide software that allows the USER to control upload & download. I suspect this section is pretty toothless under the "to the extent feasible" provision in the previous paragraph.
Bear in mind that these provisions would ONLY apply if the ISP has a cap.
