Nova Scotia Court Awards Max Possible Award

For giving ex-girlfriend a case of herpes, man ordered to pay her $218
»news.nationalpost.com/20 ··· her-218/

... For her trouble, the woman identified only as A.B. in Mr. Richardson’s nine-page decision, was awarded $218, the maximum allowed under the province’s small-claims system. ...

$218?
maximum allowed?

Something seems wrong here...

Lawsuit for herpes? I'm surprised the judge awarded her anything.

Like any venereal disease it takes TWO to tango.

Has ANYONE else ever been awarded a court judgement over a case of the clap?

Even cases of HIV which were transmitted by consensual sex are not usually dealt with inside the legal system. AFAIK there's only been a handful of cases where it was treated as assault and then only because it was transmitted without the second parties being warned the condition existed.

Herpes is generally pretty obvious and the symptoms are quite visible. Not to mention that as far as STDs go, it's more of a nuisance than a deadly condition. Like I said, I'm amazed the judge offered her the price of a year's worth of acyclovir

Looks like the rules of procedure only allow $100.00 for pain and suffering and the rest is damages for drugs she bought.

Depending on the study you read, between 20-50% of the general population has the Herp's... Many are asymptomatic for years, if they ever have an outbreak at all.

It was the lack of disclosure that would have been the issue - that he knew, and didn't tell her, that's the offending act; not that she got it.

Its obvious if its active but not so if dormant
It can be dormant for years without a flareup

Nonetheless, anyone unmarried in today's situation who indulges in unprotected sex is a moron to begin with. If she was stupid enough to be persuaded by her boyfriend to have sex without a condom then she got exactly what she deserved.

Besides, herpes is transmissible by anything from a dirty drinking glass to a warmly used toilet seat. Seriously I dunno why they even classify it as an STD. Back when I was a kid we just called em cold sores and nobody ever thought of it as an STD.

Well herpes its nothing new is it ? unprotected sex say 40 years ago maybe was a little less risky in terms of STD , then AIDs came along.

I remember having cold sores as a young kid way before any serious action with females, but all it takes is a kiss and bingo you got it.

Yea, and I fully support punishments against people that knowingly transmit an STD to someone else. I'd go even further than that and support laws that punish people for transmitting an STD to a sexual partner they're not married to... I guarantee you that would reduce STD propagation.

there would be a counter effect of that, one being prostitutes would be constantly in court, and people would constantly be in court.

counter-productive.

Frankly there's a whole lot of confusion still out there today when it comes to herpes.

There's Herpes Simplex, Zoster Herpes, Shingles, Genital Herpes and good old fashioned Chicken Pox.

They're all caused by the same virus, yet somehow everything except shingles and chicken pox gets labeled an STD.

I've had chicken pox as a kid, herpes simplex as an adult and will probably end up with a case of shingles someday if the odds are correct.

Then again in the 70's nobody ever heard of "herpes."

All I know is that nowadays if you don't wrap it up like an egg salad sandwich you stand a good chance of dying of HIV.

Frankly I just find it easier and safer to stay put and surf internet pron these days

Like lugnut said its quite avoidable through use of a barrier, no need for any punishment , punishment comes naturally if you dont use protection.

Condoms help reduce the possibility, not prevent it.

Assumption when using a condom is there are no holes in the condom , therefore risk is very low.

Re: Nova Scotia Court Awards Max Possible Award

you clearly know nothing about the std,,you cant get it from a towel or seat,,also its been linked to memory loss and brain damage and makes it easy to aquire hiv/aids also causes constant problems in the pernerium ,Prostate and balls causing you to become sterile it hides in the central nervous system,so tell me again how its not a serious condition, and can only be passed on through skin contact when the virus is active,,
