Always put a negative for refunds, items not received, items not as described so others can screen the negatives and be warned.
Many sellers play the refund game of sending cheaper versions of a similar item and just quickly refunding those that bitch.
They make a big profit off those that dont bitch and just accept it.

Whenever you dont get the item you bought the feedback should always be negative.

Now if they admit a mistake, paid for return shipping or let you keep the item, then sent you the correct item then they deserve positive as you eventually got what you paid for.
Now if that took a long time to finally send the correct item then you can leave neutral.

If the seller sent the wrong item. It is up to to the seller to pay all costs to ship the item back, not the buyer.
Now the seller can send a prepaid label with pickup so the buyer can just leave the package for the USPS or UPS or Fedex to pickup.

If the seller just does not want to pay the return shipping on the wrong item sent, then they just have to let the buyer keep it along with sending the correct item or a full refund.

TFB for the seller, not the buyer.

When challenging all the buyer has to say is "item not received".
The buyer never has to tell ebay they received something, they just have to say the seller never sent them what they ordered.
If they say they received something as "item not as described" then they will most likely lose if the seller tries to fight it.
If there is a tracking number, the buyer just needs to say his item was not in the box and never admit to anything being in the box.
Until the seller sends him the correct item then the situation is "item not received".

Ebay is all about bidding, maybe you bidded on this item? I don't know much but I know I would'nt be envolved with any bidding via virtually (the internet world) and I would'nt walk into some website and just buy say for an example a game or program that they have up for sale, get it and install it and expect it to work or be something totally different. I take a look at WOT.com first before even browsing that specific website/address but ebay can be dangerous (if your buying from the wrong people) or it can be a safe and relevant browsing website with buying options.

My point here is, maybe buying the class or brand higher up will give you exactly what your looking for.

I completely agree, but sometimes leaving negative doesnt hurt the seller at all, especially when they do a ton of business. For example, I left neg feedback for a cell phone battery seller on Ebay, in 8 hours, my feedback was on the 3rd page of his feedback, and didnt effect his score.

I didn't see where you specified you did not get the item that was listed but rather it seemed you were saying that they listed a more expensive version and had photos of a more expensive version but sent you a brand new item.

You didn't say they advertised said expensive model and pictured said expensive model but instead sent me a used different model.

But now that it has been made clear it would be outrageous for you to accept the measly 3 buck refund they initially offered.

As an eBay buyer you should expect to get the exact item you purchase or a full refund, price plus shipping.

Yes the seller was hoping you would take the 3 bucks and be done with it. That is a poor seller.

We went back and forth, and I showed them how EVEN THE ONES THEY SENT ME, USED, are cheaper on AMAZON BRAND NEW. Clear enough for ya?

And the phones are defective, one channel doesn't work.

I guess they realized my review was going to be pretty bad, so they relented and refunded me.

Now I will shop more carefully, and lessons learned about not trusting photos and claims.

Man, every purchase I've made of late has been some sort of big hassle, everything. Guess I should bother buying lottery tickets!

If they sent you what they listed but Amazon has it for less then they did not rip you off. Seller is just more expensive. Next time research your product/price before buying.

If you did not get the item they listed you can file an "Item not as described" with Ebay. In this case the seller is obligated to make right on the transaction. It may involve some effort on your part such as getting yourself to the P.O. but that is the nature of eBay.

The seller is required to prove that the item was delivered. If they didn't ship with a tracking # then they can't prove it. Shame on them for not doing what they are supposed to do.

Accusing the seller of not shipping an item through the USPS when in fact he did is a crime. It is theft by deception and when the USPS is involved it can get really nasty.

Yes by all means commit postal fraud. How about determine first what you will be able to do if the purchase does not go as planned and work backwards from there. If you know that you are unable to ship an item back, buy locally. If you can not afford to throw away $25 don't send it to some stranger on the Internet and then bitch when you think the return process is to cumbersome.

Reason I ask, if they are a bait-and-switch scammer as you claim, I'm pretty sure you will find feedback accounts backing that up. Unless of course, this seller had a stellar past performance history until you came along and they decided you were the perfect one to scam.

My advice to you and anyone else dealing on eBay.. before bidding/buying, always review prior feedback - look back to a year or more if possible. The feedback you see will pretty much tell you all you need to know about the seller, especially a "power" seller with a large selling history.

Yeah, I suspect they did this deliberately. But maybe not, and the item is too cheap to bother. And besides, the sound quality isn't bad, I just reviewed IEMs that cost more and are crap in comparison, same brand. Thing is, sound quality is subjective, I have bad hearing compared to the average 16 year old, for instance.

Why must I always learn things the hard way?

I kept wondering why the two photos looked different, but failed to connect the dots of thinking to ASK them. Doh! They ARE a power seller.

The item HAS the model number in bold label right on the device. It appears that they took photos off the web and did a bait and switch, and are trying to profit off of small differences.

Considering the cost of bus trips (2 each way), the cost of time, the cost of returning and the original shipping, to get back what they cost, it is not worth it, but I'm not going to give them a good review. It wasn't a mistake because both models are sold online, the ones they advertise and the ones they sent, if they had made an error, it wouldn't be the exact name of something selling for more, especially not when the phones look different and are clearly labeled.

In any event, for the amount of money that this is, I'm done with this, no need to respond further especially if you're gonna say too fucking bad or something unkind like that, instead, just be quiet.

The nerve of some people.

OTOH, they are surprisingly good sounding phones for what they cost, so I am cutting the losses and accepting the partial refund.

If they had sold these as what they really are, they probably would have only gotten half as much for them, but it's all chump change, so...

What should I ask of the seller? I don't want to pay for or travel to the PO because it is a major hassle and a cost, too.

I actually WANT the right phones though, as they are better and have a better fit.

Seems every other ebay thing I do, something goes wrong, is that typical? I don't know, maybe I'm just unlucky?
