The seller is required to prove that the item was delivered. If they didn't ship with a tracking # then they can't prove it. Shame on them for not doing what they are supposed to do.

Accusing the seller of not shipping an item through the USPS when in fact he did is a crime. It is theft by deception and when the USPS is involved it can get really nasty.
