Re: Voltage - still no cease and desist letter? It's strange how things like this can linger with no progress towards a resolution. Sometimes it reaches the point where everybody has forgotten about a case and it pops up in the news years later with an update or outcome. Mitnick's situation comes to mind... |

They're waiting on CIPPIC's motion to intervene to be decided. Ya, I'm sure they are but at the same time if they aren't sending out the cease and desist and there've been no rumblings about scheduling yet... It makes me wonder if they're ready to toss in the towel but are stalling to see if the judge will deny CIPPIC. It also makes me wonder if they are doing that, is someone documenting it to show that they've been acting in bad faith. |

| Also, theres this from the Canadian Broad Band forum
This also has Canipre earmarks and that Barry Logan guy messed into it.
I expect we'll see more TPIA suits soon, being fought in Toronto and Montreal and who knows where else next, all for basically the same type of subscriber information. -- ----|- From the mind located in the shadows of infinity -|---- Nine.Zero.Burp.Nine.Six Twitter = Twizted Zero Chat = irc.teksavvy.ca |

 | While slightly different (Voltage is only going after those who it captured at 100%) #3 is where I hope Voltage gets slammed as well. Many of their supposed copyright claims they are the foreign sales rep - not the copyright holder. Copyrights remain with the production company and are not assigned in foreign sales deals. Most of them belong to small production companies based in the US, a WPTO (might have this acronym wrong) country, which means those production companies are the ones who have standing to sue. |

| reply to JMJimmy A judge just ruled on CIPPIC's intervention. Michael Geist just tweeted it: "Ct grants CIPPIC motion for leave to intervene in TekSavvy - Voltage copyright case. Have right to file evidence & cross-examine"
This is gonna get gruesome for Voltage. -- Battle.net Tech Support MVP |

| reply to JMJimmy A trial of the evidence... Voltage really doesn't want that considering the Germany case - it's the only time the evidence has been tried, and it was all thrown out.
As well, there have been some major decisions lately in the US (who've seen this a lot longer than us), and they're doubting the evidence, and saying it's not enough to get a court order to get subscriber info. -- Battle.net Tech Support MVP |

| reply to JMJimmy Marc got the document up. »www.teksavvy.com/Media/Default/C···nted.PDF
Essentially states that BECAUSE Teksavvy wouldn't fight it, and because of the thousands of potential defendants, CIPPIC was granted full intervenor status.
Which they didn't get in the BMG case.
What that means, is they can submit evidence, and cross-examine the affidavit from Barry Logan, and can probably put his butt up on the stand. -- Battle.net Tech Support MVP |
