Cap Reduction CCTS complainants unite!Hey guys
I am proceeding with my CCTS complaint, and the whole thing is just leaving me feeling dirty.
Telus is pretty much coming as close as possible to lieing as you can (and they may be crossing the line.. I am clarifying) and so far the CCTS, or at least, the rep I'm dealing with seems to be slanted in their favor.
Anybody also dealing with a CCTS complaint on this issue please send me a PM or IM so we can compare notes.
I'm particularily interested in hearing from CCTSRules (anon user) who said they found in his favor.
thanks |

In the other thread going about this it was stated that the Tony Merchant law group should be contacted.
I'm going to assume you are in a contract, and not month-to-month.
I think you should do this, if you are in a contract situation since they made a "material change" change in service which is going to end up costing you more. This was not the contract you originally signed up for. It will cost you nothing to put it down in an Email and send it off to them
They already have a class action going against telus & Bell for similar when they changed peoples contracts on Cell, which ended up costing people more.
Videotron also ended up in a class action for this very same thing.
And if they want to charge you a termination fee to leave this lop-sided and one-sided contract, Well, there is also class-actions against that since they are the ones who made the "material change" to the service contract.
They sold you something for a certain price, and now you aren't getting it. In addition it will increase your costs, which again is not what you bought, at the rate you signed on for.
At most I can see the CCTS working to end contracts w/o termination fee's. But, the class action should still be brought up for breach of contract.
Telus was in front of the CRTC the other day and basically said they want to have the right to change terms midway through your contract w/o any reprisals, such as class actions, and is seeking for the federal regulatory to make this happen. In addition they will be filing to have "fed telco rules" to supersede any provincial consumer protection laws on constitutional grounds.
Seems to me Telus doesn't really give a damn about you or their contract they made with you, nor do they care about any Consumer protection laws.
I would contact the Tony Merchant Law group and get info.
Not like it's going to cost you anything to get info from them or to start it off. Fight back. Or just pay and be happy. |

As well as make everyone aware on social media networking sites (spread the word) of what Telus is trying to do, and hopefully everyone who wants to sign up on a contract because they wanted the 'free goodies' will steer clear of Telus's new practice of reducing services and charging more for less. Just imagine if they tried this on the mobility side |

said by South_of_22:Just imagine if they tried this on the mobility side They have done similar on their mobility side. It's now a class action. Also, everyday last week the likes of Telus, Bell and Rogers were thumping their chests stating that they want to be able to change contract terms at any time and force you to stay in a mobility contract no matter what. And without any recourse. You can read it all here, or view the video's on CPAC.ca » The New Wireless Code Hearings. Live Stream @ 9-amThere is no imagining this, South_of_22, they stated they will fight for this and fight so that you (all Canadians) have zero recourse. And fight all provincial consumer laws based on constitutionality to get their way to be allowed to screw you in contracts. Watch the CPAC video's. 1. » www.cpac.ca/eng/direct/cpac22. Click on the "specials tab". 3. Scroll to the Monday, Feb 11th, PM (part 2) video. Then it continued (wrapped up) on the Morning of Feb 12 (AM, Part 1). 4. Direct link may or may not work: -Feb 11 PM video: » www.cpac.ca/eng/videos/83727-Feb 12 AM video (wrap up): » www.cpac.ca/eng/videos/83735In other words, Telus is fighting hard on two things here: 1. To take aware your rights. 2. To lessen and revoke any provincial Consumer Protection laws for any of their services (and any Bell and Rogers services). They stated they want to be able to change anything and keep you locked in. This is what they are trying with you guys here. I hope to hell you fight a little... You do have rights, and they do have contractual obligations to you. |

So in other words. Don't sign up on any long term contracts.
They can keep their crappy promo/freebie gifts.
Choose to be on a month to month or pay as you go plan.
Buy your device up front contract free. Choose to port your number to X-provider whenever you want.
Gives you to option to drop/change providers as you so choose without penalty.

Could this be one of the possible reasons why they current government wants to dissolve the CRTC? So that the current providers can make up their own rules in order to maximize their profits? |

I'm not sure where you got that the gov wants the CRTC gone... But in regards to the contracts, a contract is binding on both parties, not just one side. But the telco's/Telus think there should be special laws that make a contract binding only on you, not them. Twisted or what? Promo's and "free gifts" are only a method to lure you into a contract and lock you in so you don't go else-where. Nothing else. |

You can... just not with Telus. Use one of their many wholesalers (They use the same line as Telus does, so essentially you'll be getting same quality service).
In many cases, unlimited is cheaper than Telsus's non unlimited. |

A CRTC decision came out yesterday which dropped internet access rates in Telus land for wholesalers, » Major CRTC decision next week. - CBB. So Teksavvy (a telus wholesaler) will be offering unlimited (think they already are), and the faster speeds soon. Since prices dropped, there might be a price change on their website as well as speed increases in the next week or two. So yeah, you can give the finger to Telus and go with a wholesaler if you want. Bigger bang for your buck. Ask your question in the TSI forum, » TekSavvy and they may be able to fill you in on new prices or speeds that will come out in the next week or two. |

Well, I didn't hear from any other CCTS complainants about this cap business. I have heard back from the CCTS and they are strongly indicating that they will not find in my favor.
So it seems Telus' can do whatever it wants - sucker you into a contract, reduce your cap to 1GB and charge you $900 a month. It's disgusting and immoral and Im certainly going to do what little I can to raise awareness about what utterly evil people run Telus' and set their direction and policies.
If there IS in fact somebody out there that had the CCTS rule in their favor, I'm still waiting to hear from you. |

Who cares what the CCTS is indicating or suggesting. Just file the complaint. And also fire off an Email to the Tony Merchant law group about it. |
|

it's filed, I've gone through the whole process, just waiting on the formal response.
the other thing, we'll see. |

Keep us informed of how it goes. copy/paste any reply you get
What matters is that you tried instead of doing nothing like most people.
And you can at least take pride in knowing your CCTS complaint just cost telus money (it's free for you, but not for them). |

I got a call about an offer of a negotiated settlement today. It seems that my case was not as weak as my terrible CCTS rep led me to beleive, or as weak as she tried to MAKE my case.
However "informal" , plus not addressing the price change which also amounts to a material change in service, isn't good enough at this point. I have rejected the crap proposal and have asked for a formal recommendation.
Anyone else have experiences to share?
I am tired beyond belief being treated contemptibly by telus' lawyers, telus CSR's (escalations only), and the CCTS.
I would love to end up taking these b****ards to small claims just to strike back for the little guy and for the next person to be treated in this high handed money grubbing manner. All it will take is a little more encouragement and I'm getting there. |
