They do if you read their TOS. But that is a huge problem today. People do NOT read their TOS/AUPs. If they did, they would find out a LOT about a service/product before they purchased it.

Most TOS/AUP are in legalese, not simple language.

No one should expect a Walmart customer or other ordinary consumer to read them comprehensively.
