Congestion on Comcast Peering

At night (here in San Jose) I am seeing major packet loss from several ISPs to Comcast, including AboveNet and Cogent. I contacted the ISPs, who told me that this is a known issue, and that Comcast is refusing to upgrade their ports, similar to what happened here:

I have not seen any recent reports on the NANOG list and would like to know if others here are seeing similar problems, and if so, who at Comcast is listening.

FWIW, the info at that link is over two years old. Could things possibly change in that amount of time ?

Cogent doesn't have the best reputation for their peering relationship and if history holds true, they could be pushing the limits as they have done many times in the past. »en.wikipedia.org/wiki/Peering
