Caps were not OFFICIALLY announced until may 2011. With the expectation of finalization for Uverse side in 2012. ( I have zero doubts of early beta's in 2009, but unannounced beta's are a different thing altogether )
Enforcement has hit a technical snag, and its not a top priority at ATT, but it is coming.
