It isn't, but there isn't any kind of penalty if the state loses in court other than having to release the report. So they really lose nothing by stonewalling.

Gov't can refuse any FOIA request. If you don't like their decision, you have to go to the courts to force the issue. 2 yrs later, maybe you get the info.
