| It isn't, but there isn't any kind of penalty if the state loses in court other than having to release the report. So they really lose nothing by stonewalling. |

Gov't can refuse any FOIA request. If you don't like their decision, you have to go to the courts to force the issue. 2 yrs later, maybe you get the info. |
