They don't have a right (BTW -- most of the things we enjoy are a privilege, not a right) but if they have a cap, it's certainly possible that they could legally use part of it to deliver for-profit services (i.e. ads). They'll write it into your TOS and claim that the service price and caps are built upon the assumption they can do this.

I'm not saying ad injection isn't sleazy and wrong for lots of reasons. I just don't believe an effective argument is based on them using part of "your" cap.
