The "who am I hurting" argument is weakened by the fact that modern P2P technology tends to involve more than just one person in the process; by downloading a file, you're also sending it to other people. I think that ultimately it ends up as a net positive for the publisher (I'm arguing that piracy within reason helps copyright holders rather than costing them revenue), but you can't pretend that downloading something via P2P is a one-to-one relationship, because it's not.
