Insane latency / speed issues

Alrighty, I've been a reader of dslreports on and off for the last several years, but never really had a serious issue to ask for some advice on.
I have noticed that there are other people with a similar issue, but none seem to have a resolution. Was hoping that maybe such has changed and that someone is wise enough to know what to do to fix the issue.

For the last four months I have done nothing but call and report the issue I am having, no no work around or fix permanently.
So, the issue I am having, well lets get to it. I am a Charter subscriber running 30Mbps down 4Mbps up in the St Louis Metro East, and I am a PC gamer.
Every night between around 8pm and 4am, when I am playing games online, I notice an insane ping spike. I go from around 20-50ms latency to 200+, randomly, and it stays consistent for a couple of hours at a time. When I notice these ping spikes, my net speed drops from 21-30Mpbs to 1-4Mbps, and stays that way as well for the duration of the ping spikes. There is packet loss, slow speed, high latency.
Before the technicians started rolling out to my home, my net was trying to say I lived closer to Wichita, KS. Routing was horrible.
Also note that the issue happens whether plugged into the modem, or into the router. Does not matter, the line has no objection to being problematic either way.

So far, what has been done:
3 techs and 1 system tech have been at this address.
First tech replaced the drop & line to modem.
After visit, went to pick up another modem, went from the existing Cisco DPC3008 to a new DPC3008.
Second tech came out and looked at me like I was stupid, due to it being intermittent, couldn't do anything.
After this tech came out, the Wichita, KS issue was resolved and my net started directing to Olivette, MO.
Agent on the phone was confused, and we still could not resolve the issue. Went and changed out modem and router, since they were convinced it was my equipment.
Went from a Cisco DPC3008 and a Dlink DGL4100 to a Motorola 6141 and a Netgear N750; swapped out all ethernet cables as well.
Third tech changed out the data filter up on the pole, thinking that might help, and bumped the issue up to a system tech.
System tech came out and adjusted the amp and changed signals around.

None of these visits accomplished anything.

Signals currently: 44TX 1RX 38SNR, speed 3.3Mbps down, 4.1Mbps up.
My upload speed never changes, but my download speed takes a massive hit.

Charter does say they guarantee 70% of advertised speeds, I would definitely say I am far, far from that.

So, the reason I post here tonight is to ask.. Is there a way to find out if maybe it's just my network adapter, or a better way to find out / prove it's a charter issue?

All I know is that I don't want Uverse in my house, and I will do near anything to keep Charter.

run trace route and ping test

That will at least determine where the problem is occurring. No point is rolling a truck to your location multiple times if a trace route indicates the latency is somewhere within or outside the Charter network.
