Does this statement apply only if you rent the modem and/or gateway from Comcast? So what happens if I own my own motorola modem and use an asus wireless router? Does Comcast use QoS at that point and throttle my speeds during peak hours?

It's a sales claim to get you to use and pay for their gateway device.

What they don't say is that any decent properly configured wireless router you can buy for yourself will do just as well.
