Re: [Mobile] Bell Mobility Expiry Dates Illegal?

LOL, I can see it now... any moment now, rates for mobile subscribers will arbitrarily go up $5/month so Bell can hire a team of world-class lawyers to fight this case to the bitter end. Then, after they make a mockery of the legal system with repeated appeals until they win, they'll somehow introduce even more punitive billing systems for pre-paid mobile subscribers! And then, they'll try to individually sue all the plaintiffs from the class for wasting their precious time.

I'm surprised it took that long. In Ontario, gift cards are not allowed to expire. A pre-paid plan is not all that different from a gift card. You pay a company money in advance for the purchase of goods and/or services.

It'll make for an interesting ruling.

Nor does a finding in favour of the users make it illegal ... It may find simply that it's an unconscionable contract term (contract terms that no one would reasonably accept except for that it's essentially forced upon them with no reasonable opportunity to negotiate it out.)

Being challenged in court does not inherently make it illegal. The whole point of a court case is to determine whether what they're doing is legal or not.

When the court case is decided, we'll know whether it's legal. Until then, it's up before the courts. That being said, if you have had a prepaid cell phone with Bell, you should contact them to find out more.

Bell's pre-paid phone plan expiry dates to be challenged in court:

The Ontario Superior Court has classified a class-action lawsuit against Bell Mobility that alleges that the company's practice of putting expiry dates on its pre-paid wireless plans is illegal.........
