[Help] Helping widow get duplicate title to late husband's pickupI need to know how to help my grandmother get a duplicate title to her late husband's pickup. Her name is listed on the title as well but I need to know how to go through the process. It's in Maine and the truck is free and clear of any liens.
I'm getting that truck. He wanted me to have it. Then once we have that Maine title we're going to have to go to that bureaucracy called the Massachusetts Registry of Motor Vehicles to register it and it will have one of two owner's signatures on it, the other owner unfortunately is no longer with us.
Big catch is I need to get plates and it needs front end work to get a sticker, not to mention it hasn't been started in over a year. I used jumper cables to light up the electronics so I could get an odometer reading. And the biggest catch of all is getting it from Maine to Western Mass without an inspection sticker, you have a 7 day grace period but those state troopers are ticket happy and fighting a ticket ain't always easy. Having not been started in a year means it's not OBD II ready for emissions testing.
I'd drive up in my Stratus with the plates, attach them to the truck, drive the truck down and take the bus/train back to Maine and collect the Status and drive it back. |

Ya really, like, go to the DMV and ask them, you have two people on the title and one can not sign.
Only the DMV is going to be able to MAYBE tell you what to do, they may want a copy of the death certificate, they may not, may depend on who you ask. It's the dmv...
I took a dump bed off a truck and put on a pickup bed, truck was lighter, I went in and figured no problem right? I'll be paying them MORE in tax... they make out... paper work said nothing about anything just "list modifications" nope
I had to get a joke weight slip because it changed (I say joke because it was a slip of paper, from a NYS registered scale (friend of mines junkyard) with NO vehicle ID info I should have and could have just weighed something that was 5500lb I would not have needed commercial plates). So now I have a pick up that can "only put 3600lb in the bed" (exactly what the lady at the DMV said) LOL okay.
Okay I go back, with all the same paper work. O now for this person the bill of sale is not signed... that's a problem she can't accept it... she looks at it for a few seconds, they don't care! Just give me it back... and say "they won't care on a vehicle of this age" okay great thanks... lol
Moral of the story. I'd just call and ask. |

Can you have it towed (or transported) to the state it will reside in and have the work done there to make it road worthy. Seems like it would save you the hassle of brining it up to legal just to drive out of the state and save on a registration. |

Cannot tell if your question is about having the Title or it is misplaced or lost.
For what it is worth here is what I did. In Washington, I had the Title and a certified copy of the Death Certificate [I have multiple certified copies]. Went to one of the Satellite Licensing Offices [privately run].
Took my Mom's name off the Title, kept Dad's and put my name on Title. Did it this way as Dad no longer drives, I now have an insurable interest and exposure. I will put the vehicle on my policy.
Walked out with new registration papers and a new Washington Title will come in 4-6 weeks. Renewal was due, so took care of that. Emissions every 2 years for the type and age of vehicle.
Investment of time - 45 minutes or so. They were not busy that day. |

I'd like to have it down here in the interim. Unfortunately this money hungry state will charge me the sales tax on the book value when I go to the RMV. But we need a duplicate title as the original is lost. |

You could always get a tow bar and tow your car, or rent a trailer to tow the car behind the truck. It might save some cash. |

Then go to your DMV and tell them that, and they'll take care of it. Happens all the time, you know. There really isn't any need to get Internet forum advice for that one, is there? |

At least in Florida, if the title has an "OR" between the names, either person can apply for a title. If it has an "AND", then both are required, except in the case of a death. Then you have to provide a copy of the death certificate.
Straight up call the DMV. Tell them what is up, and they will guide you. Should be pretty straight forward. |

I do not know MA law, but I will look it up. They charge Sales Tax in WA too but there are exceptions to out of state vehicles. I see MA has similar laws. When I changed my Truck's Title to WA I was not charged Sales Tax. WA has very similar language as MA. I did not get all the forms and pre-fill them out ahead of time. I just went to the Titling Office and had them do all the forms there. Since the Truck had a lien, I just brought in my WA Drivers License, proof of Insurance and the Truck's Registration Papers from the other State. Methinks you are overthinking everything, what with all the tasks you have on your plate right now. And assuming a lot of things based on past experience. As you are thinking of legal things, may be time to see if your Grandma has an up to date Will and POA [Power of Attorney] and other Legal Papers dealing with Health Care and HIPPA and such. Trust me it can save thousands of dollars later. If one does not have such in my area, Seattle, Attorneys have reported an uncontested Guardianship can cost over $5,000.00 and take over a month to obtain from the Court. Most of the fees here are for Court fees. YMMV. I have a friend going through this right now with a young relative who was severely injured in an accident and is unable to pay their bills. |

Or get the Duplicate Title, add your name on the Maine Title with Grandma on the Duplicate Title too and then later Transfer fully to you in Mass. Sounds like you are not going to be able to get the Truck back to Mass. right away, anyway.
I am doing something similar in Wash and it sure is easier. I just took my Mom off the Wash Title, added me along with my Dad. It saved a bunch of paperwork and fees. Just needed Title, Death Certificate and then present our Driver Licenses.
On another transaction example, when I titled my Truck in Wash, got a Wash Registration and the Title is still in Oregon, since my Credit Union has the Lien. That was the solution Wash DMV gave me. Next month's payment pays it off. Since I intend to return to Oregon will probably do nothing about that, as Wash registration states that the Title is in Oregon. I have Wash plates and tags. Insurance knows it is garaged in Wash, so I have a Wash. Insurance Policy.
Suggest you go to DMV in Maine and see what they say. |

Doesn't it have to be titled in the state in which it's registered in. So if I move up to Maine I'll have to surrender the Mass title on my Stratus and obtain a Maine title.
I thought cars had to be titled where they were registered in.
Maybe if I add her name to the title then I might be able to get out of the sales tax now that she is in Mass.
We have a screwy system for registering cars. You have to have an insurance agent stamp and sign the registration application form. Then you have to wait three hours at the RMV for a 15 minute transaction. |

Whats a BB on a truck you can't drive... can't be much...
I can't believe you need to wait 3 hours at the dmv... you really can't walk in with proof of insurance and be done? I'm in NY we are supposed to have it hardest. |

I still say leave it there. Why all the hassle of driving up there to drive it back then take a bus up there to bring your car back. Then the same process again when you move up to Maine. Not to mention dealing with all the DMV crap between states. That's a lot of money wasted for something you have no immediate need for. Since you say it's been sitting for a year I don't think there's any concern anyone will be driving it. If anything I think you'd be worried about squatters taking up residence in the house. |

You could always do what I did when I bought a vehicle out of state. I bought my sister's Plymouth Breeze, titled in North Carolina. I flew up there, she picked me up at the airport. Rented a u-haul and trailer, towed the car back.
To make up the money spent on the flight and rental, a friend of my brother-in-law's was moving down to Florida. So he paid for the truck, trailer, fuel, and my time for me to drive the truck to his new place. I ended up only paying for the fuel from his new place to my place. |
