Though I simply provided them with their notice number, I did not state any personal details, nor did I give them my ip where it wanted me too. I simply said, "I'm sorry. I was not aware it was distributing property. Files deleted without watching. It won't happen again."

Your IP and contact details are held with Rogers and ISP will not release your personal information without a court order. But I doubt it will go that far.

I actually don't think it will go anywhere. For future, exercise caution when downloading copyrighted North American content. If you absolutely need to download, at least encrypt your traffic, ex use TOR

As others have said, it's highly unlikely anything will happen to you. The copyright owner would have to petition your isp for your personal details (likely cost $100 or so), then pass the information to a copyright troll company/lawyer (incurring more expenses), who would then contact you demanding a settlement out of court or they take you to court.

If they take you to court, again incurring expenses, they risk receiving an award of $100 which does nothing to cover actual costs.

If the court(s) do decide to declare an award of $100 per infringement, the copyright owner(s) will be out of a lot money.

The situation of copyright trolls in Canada is still fairly new; the above will be seen as a test case.

I appreciate everyone's help thank you. I have calmed down considerably. I have seen the error and have zero interest in torrenting (the worst part is i barely torrent anyway, my household owns collectively over 1400 dvds and vhs, and this was just a...well there's no cheap way to view this movie so.....)What companies fail to realize I think is that our options are renting (often $7-9 for instant services or buying the movie at $20 but often $24 a piece). They need more legit streaming services/expanding available ones like netflix. I know redbox is trying but when that source is often unavailable (our local one was out of service nearly every time we went, we called a bunch and they assured us it was working).

But yeah, thanks guys, basically the scared me away. Which I read works for many people when they receive the notice and notice emails.

From what I read of Mark Monitor, they aren't your typical copyright troll like Canipre. They are far more about brand protection and copyright protection rather than extorting money out of people. In other words, better to get people to stop violating the brand or copyright than trying to make money out of them.

It has generally been some of the distributors of dubious films that have been going the route of copyright trolls to make up for the revenue their films didn't make at the box office or the video store (like the porn makers!!!)

A popular movie from a big movie house is hardly likely to take this dubious route of pissing lots of people off to make up their revenues!

kidcanada, I honestly think you have nothing to worry about.

I have been telling people for years to stay away from torrents but do they listen ? No.
There are any number of websites where you can safely download what you want without Hollywood et al peeking at torrent swarms pulling out IP's.

So, yes, for you, it's a learning experience. Now go tell everyone else in your home to stay away from torrents.

Most of these "strikes" things are agreements that ISPs have negotiated to ensure that there is no legislation brought to bear on them and no lawsuits brought against them.

I think the real lesson here is pretty simple: stop using BitTorrent. It's not like there aren't better ways to download linux distros.

Doesn't the lawsuit notification fall under the 'Nail and Mail" rule that requires mailed notice of the suit with a return receipt? I was once subject to "Sewer Service" (the practice of the person who supposedly was to serve the notice - The Nail part) filing a false report of service. I was able to beat it since I was provably out of town at the time - something that the server was unaware of. As to mailing, they did not bother to mail me a copy (even by standard mail).

And people still download and watch movies put out from these clowns?

I don't believe I ever saw any of their movies (Including Hurt Locker, which I was interested in seeing until the stuff with TekSavvy started), nor do I have any interest in seeing anything that they put out. And I hope that others do the same. If no one goes and watches their movies, either legally or illegally, they make no money and can't afford to make new ones.
