Re: GET OFF WINMX OPENNAP SERVERS ASAP! Update this is the last email I got. My service will be shut off because I refuse to delete the files from my computer.
We have no relationship with Sony and have not given them access to any of our network or any customer information. Sony uses its own technology and people to detect infringing activity and you are free to follow up directly with Sony for further information.
Sony's complaint goes to your offering the Korn material to others for copying. Please recognize that your actions have threatened this company with exposure to liability for contributory copyright infringement and the requested actions are necessary to shield us from liability under the Digital Millenium Copyright Act. See our Acceptable Use Policy.
So we need you to delete any copies of Korn songs that you have downloaded from the web as well as the P2P programs. We then need for you to confirm you have done so by email to me. If we do not receive this confirmation by 3 p.m. today your service will be suspended.
You must also follow up with the requested letter by fax or mail to me at the address I have provided several times in this string. If we do not receive this letter by April 5 we will suspend service until we do receive this letter. If you would prefer to terminate service of if we need to due to an insufficient response from you, please note that you will be charged an early termination fee pursuant to the terms of your service agreement and the Acceptable Use Policy.
Upon reciept of your email confirmation, we will notify Sony that we have been informed that the infringing activity has ceased and they will be able to independently verify this.
As I must turn my attention to other matters, this will be my last message on this subject today. |

| Just unshare Korn files.
And ask them if they prohibit use of P2P apps. Get it in writing from them.
edit: and ask for a different IP address because you don't feel safe with someone tracking you around on the internet. [text was edited by author 2002-04-03 17:43:05] |

Like araina said, first unshare them.
Then, just burn the mp3s (in mp3 format) to a CD-R or CD-RW. You can probably fit the entire friggin Korn collection on (1) 25cent CD-R anyway, then delete them.
Now, whether you put them back on later, I have no comment on that...lol -- If you have to ask what EFNET is, you don't need broadband |

 | reply to quickstang22$ Better than deleteing the infringing files and proggy, turn the proggy off and tell them that you deleted it! No need to delete anything. Later on turn it back on but don't share anymore Korn or Sony music for that matter! I don't believe any ISP has a rule about P2P proggies so their asking you to remove that is probably a no no! |

Looks like they are going from this - part of their AUP:
Infringing Intellectual Property: Using the Services to transmit any material (by email, uploading, posting, or otherwise) that infringes any copyright, trademark, patent, trade secret, or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software. -- Kent-----------If the good Lord had intended us to walk he wouldn't have invented roller-skates. -- Willy Wonka |

 | reply to quickstang22$ Try getting some kind of encryption software and encrypt the folder with your MP3s. I'm not to familiar with encryption, but I think that's one way to hide your songs. |
|
 | reply to quickstang22$ Hey Quickstang45, put your downloads on one of those pull-out hard drive casettes and leave your music at a friends house or hidden where it can't be found and if they come to "investigate" your hard drive, they won't find any music, they will find your other hard dive in the machine and no music. Then counter sue the bastards for harrasment. |

 | reply to quickstang22$ I feel bad for being just a leecher. Anyone want to buy a korn CD? |

You should send sony all your Korn cd's and tell them where to stick them. -- Over 55 Billion served. |

blah, quicker and cheaper to put them on CD-R ....(if he really wants to delete them off HDD)..... -- If you have to ask what EFNET is, you don't need broadband |

 | reply to quickstang22$ If they want my MP3s deleted they can come over to my house and delete them. I'm not deleting anything! |
|
 | reply to quickstang22$ My 2 cents: We all know sharing copyrighted material is illegal. Sony is just protecting what's theirs... let them. They're shooting themselves in the foot. They are pissing off current and potential customers. If you really want to be pro-active about this, contact Korn and tell them what their label is making them look like... unless they are the ones initiating this, in which case, they are as evil as Sony. But, Just stop sharing any mp3s that are from a sony label, and they can't do anything. And your ISP shouldn't even care... they aren't sharing anything. If Sony went after the ISP, they would lose. It's like suing Ford for making a car that hosted a drug deal. They provide access... What you do with it is not their concern unless you are attacking them. That's my 2 cents. |

There is nothing in there that prohibits the use of P2P, FTP, or other information xfer program. They're simply telling you that if you get caught you might get tossed from the ISP.
The letter you were sent only lists one file. I'd remove that single file from your shared directory and fire off a confirmation FAX that you complied with the notice. Let 'em waste time rescanning and asking you to remove additional files as they find them...consider the responses you need to send as the "cost" of using P2P.
The big hole in Sony's scanning to curb illicit P2P activity is that they can't prove criminal intent the first time around. After all, lots of computer users out there don't have a clue how to limit network shares, configure firewalls, and generally leave their machines somewhat open. The person that they can prove criminal intent on is the one who's downloading the files. Of course, Sony's evil agents may have set up an OpenNap "honey pot" or 3, loaded them up with some of the hotter properties from their music library and are snagging the users who D/L from them. If that's the case here, you're getting off easy. |
