Sony is trying to make an example out of quickstang45. Sony is just trying to scare us, into thinking that they can shut down your service if you run a music sharing server. The problem with this is there are too many people to shut down, if they do they would have to shut down over half of the DSL community or people who have Optimum Online(OOL), because they have high upload speeds.

Something of this sort happened to me last year. I got a call from Charter Pipeline, explaining to me that they had received a complaint that I had been sharing several files that was on my HD & that any other complaints were lodged, I would lose my internet connection. The thing was most of the songs that they listed, I didn't have & the ones that I did have, I ripped from my own CD's. The date(s) they claimed, I just added some servers from Trippy MX & was just browsing to see if the extra servers offered anything. To the best of my knowledge I was NOT downloading or uploading. They told the time I was on line & the screen name, never the less I got rid of the Trippy MX server list. To this day I think that they were a few servers set up to monitor what traffic that passes their servers

by the way as some of you suggested he burned the files into a cd-r or a cd-rw and deleted it from his hardrive. That does not work if they want/can they can recover the files even months after they are deleted. One way to be sure that the files are completely erased/scrambled is to use a program like this 1 »www.tolvanen.com/eraser/

in my opinion i would change the song name to instead of Korn to corn and they are powerless

Well I don't know about you guys. Alot of good artists are on Sony, however I can live without them. I'll buy my music from more deserving artists without the "me" attitude. Screw corporate greed, they can keep there $19.00 CDs. Maybe if they didn't want $19.00 for a CD (not on sale) with maybe 15 songs on it more people would by them instead of going through the trouble of downloading them.

I work for an ISP in Maryland and we received the same exact form letter this morning, for the same group, Korn (who five years ago would have loved to have their music shared between fans, as they were virtual unknowns).

We typically do not threaten to turn off customer's service and usually ask for this type of letter to be faxed or sent through the mail. Whenever we ask for the record company or movie studio for this, they never bother to respond.

Why not just email:

"I have deleted all Korn files from my computer"

and not delete them...just stop sharing them. How would the ISP ever know? I don't know about New Edge Networks, but Atlantech (the ISP I work for) doesn't have any sort of super scanning technology that will enable us to magically see into your computer's hard drive. Maybe that's why they are called New Edge Networks?

Just put the files in another folder when you download them, and hide the content of that folder, they will not have a clue.

also, one way that they can tell what your downloading, is by adding some "spyware" into the file that you download, and then when you download the file from another user (who happens to just be a sony server) they "tag" you, and activate the spyware - then bust your chops.

I played in several 'small time' bands in the Western NY area in my Days. Was robbed by every bar-owner ( with 1 acception ) and stiffed too many times to recall. I doubt the folks in Korn are pissed at all.. their probably happy.. Unlike the Facists in Metallica who I refuse to even listen to anymore.

Here is how _I_ would handle it.

Go to kinkos or use a digital camera. Take a picture of 'The bird'. Make an image file of it.

Send a letter to your ISP ( I'm hoping _they_ own the equipment ) stating nowhere in their AUP or services offered letter does it say anything about you waiving your 4th amendment rights as guarenteed by the Constitution of the United states ( I' also assuming your computer is on property you own/legally reside at and your over the age of 18 ).

I would inform your ISP also to the fact they need to pick up their equipment as well. If charges are made in reguards to early termination on _their_ part, not by your request, _they_ have broken the terms of service and have made illegal financial charges on your persons.. its _their_ contract. Inform them if they wish to terminate service, they need to pickup their equipment before moment of termination.

If you pat via credit card, call the card holders and notify them _before_ this goes down and _REFUSE_ all charges they might be trying to impose.

Make flyers, toss them all over the poles in front of local media offices in reguards to how your ISP is 'monitoring' their network. Informed people are wiser people.

You kick them to the curb and hit them in the wallet at the same time. Take as many customers and give them the worst publicity they can have. if _they_ wish to cave and let someone kick you in the teeth.. Kick them back.

Its just a threat to scare you....

We get these all the time from Sony and AOL/Timewarner etc.. about shared music and videos.

Simply unshare the file and they will leave your ISP alone, you dont need to delete it.

They cannot prosecute you or your ISP as the home recording act allows you to copy the music to other media including your computer, they just dont like the fact you are sharing it with other people (Who might own it legally as well).

We just tell them (Sony/AOL/TW) on behalf of the customer that the file has been removed and thats the end of it.

You ISP should not disconnect you or give out your personal information to Sony/AOL/TW.

Sorry guys, it's not B.S. They bought these laws for a reason (D.M.C.A., N.E.T. Act, and the new CBTBA/SSSCA or whatever....) And they are going to USE them.

With all the "choices" in broadband, you only have to get "busted" once or twice and you're BLACKLISTED from broadband. This is the new war they are fighting.

Plus, they are filing criminal charges in some cases, too.
