Actually it'll be those same judges striking down the state anti community broadband laws because the FCC is federal and the community broadband laws are state so federal law supercedes state law. And the FCC has full authority to remove obstacles from network deployment.

Pot is illegal at the federal level. So how exactly were Colorado and Washington able to legalize pot, if the federal law controls?

OK, but legally, does federal law pre-empt state law, meaning that CO and WA illegally "legalized" pot? Does that mean pot isn't really legal in those states?

I'm asking about the status of the state laws, regardless of whether DOJ chooses to enforce the federal law.

The FCC has no control over the Internet nor do they have the legal power to invalidate any contract/law. They would need to go to court. The FCC shot themselves in the foot when they ruled that the Internet is an information service and not telecommunications service. By not having Telcom status- the FCC is just a half baked idea on controlling the Internet.

Actually not true. The feds are still enforcing the federal law and so are companies in those states, but that is another topic.

Yes, regardless of what the state says is legal, the Federal Courts and laws can say it is legal, once that happens it is illegal. The states could in fact lose lots of money if they cut funding for legalizing and looking the wrong way of criminal acts.

Actually the FCC has the power..The FCC pre-empted all the rules and laws with regards to DBS(sat dish) and OTA antennas.
