unlawful wiretapping

Remember when it was unlawful to tap someones communications... Oh wait, it still is.

So why do ISP's unlawfully wiretap people? Because the ISP argues that those laws were written before the internet, so therefor it doesn't apply to anything other than a standard phone.

those old laws may only pertain to analog audio, which is why no-sound ccd cameras are everywhere.

Since you specifically agree to this in a contract, that makes it not illegal and allowed.

If law enforcement came to your house with a wiretap and asked you to sign a paper allowing them to put it in your house, and you signed it, then they could legally do it as well.

There, fixed that for you. It's called the Patriot Act (and its many renewals and extensions), and it's completely legal. What isn't legal however is for the phone company to actually listen to conversations, they are to be saved for law enforcement requests.
