Can't always appeal to all the masses

Lately the trend in the Internet community seems to be "free for all, or all for nothing." EMusic has realized this and is taking steps to stop taking a beating from the freeloaders out there. There is obviously some staggering abuse to their convenient service offering.

This isn't about people not wanting to pay.

It's much simpler than that: Don't pitch your service as "unlimited" when it isn't.

Change the TOS and change the advertising.

I don't think they can really define/claim "abuse" here.

They advertise "all you can eat" and that's what folks do. If eMusic doesn't want that type of activity, then don't advertise the service as "unlimited" -- period, end of story.

Those that are taking full advantage of the service and downloading all they desire are not freeloaders if they are paying for the service. The claim has been that no one will pay for an online service, well here they are...and what do they get? "Well, we said unlimited but what we 'meant' was...."

One would think that a legal service would get this straight...obviously not.

They would be better served to change the service to higher subscription rate, upgrade their bandwidth and servers and shut up, fulfilling THEIR end of the deal...OR...just cap it for everyone and stop misleading potential subscribers.

They have no business offering an "unlimited download" service where they then arbitrarily decide how much music one could "reasonably" listen to.

If a lawsuit isn't filed here, it should be.

If they mentioned this to that dude on that letter, there must be some evident problem with the paying customers sharing their account with friends, colleagues, etc. It looks like it's boiling down to people not paying for what they're getting. I would be pissed too paying royalties, bandwidth, etc and being cheated out of those revenues.

People are downloading music, by themselves, in bulk from a service that promises unlimited downloads, and you're feeling sorry for the company who was stupid enough to advertise an "unlimited" service?

Change the ads, change the AUP, define the download limit, and you'd have no complaints.

Instead they're booting people left and right without clearly specifying why.

I guess my way of thinking wouldn't offer "unlimited" anything to any customer. One thing is to enjoy the privilege of unrestricted access to a resource, another is to literally hog all you can just because it says unlimited.

Heck, would you go to Sizzlers and eat up the whole salad bar because it is included in the buffet?

No, but if I went there to get unlimited ribs and they stopped me after my third plate I might question their advertising policies....

how can using the service according to the description be staggering abuse ?? Sounds like staggering stupidity among music execs. These must be the same ColonKids who treat bandwidth as a commodity, like oranges or something. You can't advertise unlimited use, and then complain when people do just that. If they want to limit the access so be it, it is their service but do it up front and DON'T LIE about it.
