 johnq3 join:2000-09-30 Lockport, NY | Bad news in NY ?! Last night I make my second call of the week to Telocity to check the status of my migration. Having been without home net access since Feb. 26th, I'm getting more than a little impatient when I call and am told I'm still not in Telocity database but they are still downloading Rhythms information and should have that completed in a day or so if I wanna call back then. This is the same response I get for each of my twice weekly calls since Feb. 28.
The Thursday March 23rd call seemed to start off better than the previous calls. While I'm still not in the Telocity database, (presumably they've finally obtained all Rhythms info,) I'm told my best bet is to start as a new order. I call and the rep takes my info only to inform me that Telocity is unable to provide me with service. What the...?! And this after I specifically asked early on if Telocity would be able to provide service to all former Phoenix customers (and was told that, yes, they could.)
Checking my Phoenix contract, I notice Terms & Conditions # 10 and the "...material breach of agreement" clause. I'm going to assume that since I do not have (and probably won't get) a connection, this is considered a "breach" and I'll be able to terminate the Agreement without any fee. The person I spoke with (Agatha at Telocity new orders) agreed that this would probably be the case so I'll be mailing them notification and hope (?) they'll be unable to fix things within the 30 day window.
I'd suggest that any former Phoenix customers who are not showing up in Telocity database try to place a new order and see if you'll be able to get service.
Not at all how I thought this Phoenix mess'd play out.

| Rhythms stayed in Lockport but pulled out of Buffalo? That's weird? Do you still have service or did you lose it March 1st or 2nd?
Oh, I see you lost access on the 26th of Feb. Call, email or FAX Phoenix and find out if Rhythms is still servicing your CO. If not, you'll have to order new from Telocity (which will most likely be 1.5/128 shared line) as I had to do.
Or for that matter call Rhythms at 1-800-Rhythms to see if they are still at your CO. They are easy to get thru to unlike Phoenix. [text was edited by author 2001-03-23 20:22:32] |

When I talked to Agatha at Telocity New Order Dept., she took my phone number and, after checking it, told me Telocity would not be able to provide me with service (in Lkpt.)

Thanks. I'll give 'em a call and check it out.
Either way, I sent out letters to Telocity, Megapath and Phoenix informing them of my lack of service and told them that if they are unable to resolve the situation within 30 days, to consider my Agreement terminated.
Day One and counting.

Then go to »www.telocity.com and check for service availability there. With Rhythms now gone, and of course NP, if Verizon isn't offering service then it's unlikely anyone will be able to (residential service anyway).
Your contractual obligations to Phoenix have been revoked as of 1 January. They can't hold you to any term you had previously. You get to keep your router/modem, bit if you have the Cisco 675 like I do it won't be mush use with most other providers. |
