Most of heavy-loaders get illegal stuff so they don't bother.
The rules are not clearly marked and marketing unlimited term is misleading customers, so it can be reported for some federal agency.

The user in question was capturing multiple Internet radio streams 24/7. Last I knew, listening to the radio was not illegal. | |

That way or another, they should fight.
If I was to receive one of those notices for downloading/uploading anything legit, I would do one of two things
1. Go with competitor
2. File complaint.

People keep mentioning that Comcasts terms are vague simply because they do not include a hard number which states the "invisible line", and as a result they would have a difficult time in court. This simply is not true. All Comcast has to prove is that your consumption of bandwidth was not normal, and a judge is going to agree with the "undue burdon" clause.
What is normal? While it is definitely a flexible term and open to interpretation, Comcast will not have a difficult time proving that someone who uses 10 times more bandwidth than the average user is putting "undue burdon" on the network. As this article states, a small percentage of the users are accounting for 60-80% of the bandwidth consumption. We're not talking about small differences in bandwidth consumption here.
Personally, if I was a Comcast subscriber, I would not want any hard numbers listed. Once the TOS is not vague, then they are required to respond the same way to ALL people, ALL the time. E.g. If they have a daily limit of x, and a monthly limit of y; right now I might be able to download 1.2x one day, and not hear anything about it as long as this was not a normal occurance. However, once they have a specific limit, they would be required to respond the same to all people who cross that specific limit. As a result, my account would be canceled too, even if this was the only day in the last year that I even came close to the limit. No specific limits allows for more flexibility which is a benifit to both Comcast and their subscribers. | |

Well, interesting response, now imagine that the only neighbors U have are grandparents who use internet once a month to check email and You normally use internet everyday (email, browsing, iTunes, Linux, windows Update, etc) Comparing to Ur neighbors, You are abusing network, while in reality 95% of a "pipe" is unused.
So as in legal life, hard written numbers and specific rules are the only way to go. Imagine lawmakers using relative reasoning to pass bills.
