Amen to that! -- While it might slow down some of the foolish lawsuits, there is another edge to this sword. Think of the possibility of those who have a legitimate case but didn't have "bullet-proof" evidence and did not win their case. For example, there was a local incident here where a surgeon left the operating room in the middle of surgery to cash his paycheck, and was gone for hours. The patient in reality turned out OK, but what if complications set in & the patient died because of the surgeon not being present in the operating room? And when the patient's family went to sue, the surgeon managed to get off because of a technicality & a good lawyer. Wouldn't having to pay the defense lawyer on top of loosing the lawsuit be a kick in the pants to the family of the patient??? Looser pays would punish as well as prevent... |
