| Go to jail...go directly to jail... Actually uncapping is a crime and can get the FBI at your doorstep. It's called theft of service and if you are caught the criminal penalities can very severe, on top of civil penalties. There was a well publicized case about this, I'm sure one could search google. There is no grey area here, very cut and dry. You get caught, can go to jail and have a record. -- Ken |

 rx7mike join:2004-01-23 West Bend, WI | Listen i just went through this with charter 2 months ago. Its is NOT theft of service. At best its a breach of contract. It is a civil matter not criminal. I can send you an email with copies of all the letters i have from charter and my lawyer. The most they could do to me was make me pay for the extra bandwith i used and discontinue my service. And all they did was stop my service, including my cable tv. Which I'm now getting back on saturday. Basically what I got was a 2 month ban from the charter network. They asked what i did how i did it ect...... It was wrong, I wanted to try it out. I was curious. Shit happens.
And microsoft98 why would someone want to uncap your modem? What is the benefit of me uncaping your modem? Unless i have some software installed on your machine to transmit files for me uncapping your modem would be point less. And besides to uncap a 5100 you would need physical access to the modem to make hardware changes inside it. So please for future refference dont discuss things you know nothing about. Having first hand experience, it sucks, they cared the crap outa me with a letter. Thats why I called a lawyer. they threatned to confiscate my pc's, my modems, they were mine not rented, so i called the laywer to talk to them to protect myself, and my equipment. The only part of the law that is gray is the hacking issue. Technically they could get you on a trumped up hacking charge for accessing they're network in an unlawful way. Would it stand up in court? Probably not or I imagine they would have tried. So with that i bid you farewell. |

It is theft of service. You were lucky the police and FBI were not at your doorstep. Comcast did that to a subscriber who uncapped their modem. The guy went to jail over it. It is, I believe a federal crime. Don't let your dealings with Charter mislead you. They were being very nice.

You my friend are clueless and will remain that way. Theft by meaning is to take,remove and permanently deny, deprive the legal owner of it. What you read all over the web concerning a few customers who had the FBI on their door step, note a very small ammount of people. I think I have sen 10 such cases. They were also invovled in more then just modem uncapping. And also in a community where the cable company had ties to major community officials. Also from what I have read they were not charter customers, they were comcast customers. Like i said earlier. I'm more then willing to send you the exact letters i recieved. They show the laws as they read with statute numbers. Theft can not pertain to cable modem uncapping as it is written today. Now if you were to access the charter network with an unregistered modem and without subscribing to charter's HSI then you are hacking, not stealing. That is how the law reads in wisconsin. I'm sure the laws very by state they often do. I cant speak for each state. I can only go by what they can do in wisconsin. At no time was I violating a law. Charter used 2 sections of the AUP to revoke my service. The "NO HACKING", and "EXCESSIVE BANDWITH", sections. Which they were in they're full right to do. I was getting more then what I paid for. Think about this for just a few mins before you reply. If I am paying them how am I stealing? The only reason they threw the hacking thing at me, they at the time thought I was renting a modem from them. What I do with my equipment is my own decision. I can use any firmware I want. They have since turned my services back on, today they came back and made sure everything was working. They know I'm using a altered firmware on my modem, so I'm sure they will scrutinize my activities now. Which is fine I have no intention of doing what I did ever again. I was trying it out. I wanted to see what I could do. The speed increase I made was minimal. I just turned up my upload a little, I went from 256 to 560. I wasnt out to uncap and use insane amounts of bandwith. I'm sure that all played a factor in what they did as well. I wanted my upload to actually match what I was paying for. Without overhead a 256 upload will net 32k up but with over head it is usually closer to 20k on charters network here. SO i set my upload speeds to cover the overhead. I was also running like that for a long time. Well over 6 months. The only reason they knew was they tried doing a snmp update to my modem's and it wouldnt allow snmp access.Thats what tipped them off. So anyway. The FBI will not be banging on my door. And should not have been. |
