Users of your product, thinking you are the real Microsoft, have their information stolen from you with your "Microsoft" labeled product. You then report them to the real microsoft saying that "Person A" bought and used illegal software.
Its also conspiracy. conspiracy, in law, agreement of two or more persons to commit a criminal or otherwise unlawful act. The two or more person's are known by their website as "(Justin and Clif)".

It is not piracy to download and install an uncopyrighted unpatented program that is freely made available by its authors.
And this is true no matter what filename the program is given.
That said, as a programmer myself, I have to support the idea that people should be paid for their work when they have asked up front to be paid. So I'm against theft of the fruits of a programmers work.
On the flip side, from what I read on their web page, yes there is no privacy agreement, so people who install these tracker programs are not justified in compaining about the programs broadcasting their IP address, operating system, or other common information.
If you install something and the author or distributer of the program hasn't said what it is, they haven't mislead you about what it is. So long as their doesn't cause damage (like with a virus or trojan) I think it would be a very very tough case to prove these guys were sufficient harm for a civil lawsuit, and without a crime, like theft of services, there is no chance of a successful criminal prosecution.
Anyway, that is how I feel about this tonight. |

Just because you downloaded the file while searching for illegal files doesn't mean this program is illegal.

Stealing? Nope. Except for the PID, all of the other information can be logged by anyone. Every time you search on Gnutella, people know what you searched for and your IP. Every time you download, they know the filename and the IP.

We aren't trying to prove anyone is pirating. We were purely looking for what people pirate and how files propagate on Gnutella.

No, that's one of the pirates faking an entry. Doesn't take much more then a hex editor or a packet sniffer. You can even tell that the person who submitted that wasn't too smart, other entries from that user had the original data in it: the %s and %d.

Do you really believe a keygen is a legitimate piece of software and that you have a right for that keygen to be what you thought it was?
The Paris Hilton sex video is a copyrighted work and is not a legitimate free file just because it's widely available. And if you're stupid enough to download a 470KB video with an .exe file extension you deserve what you get.
I have no idea what Griffin Clifton is a fag.exe is but if someone is willing to explain what the legitimate free download of this file is, I'm willing to listen. |

That is what I said, and what I was trying to imply/point out, is that someone replied with a "You are gay" response to the creator.
It's real easy. You create this program and send it out. Bob picks it up, does something to it, and makes it reply to it's creator with "You are gay".
I was guessing the file name said the "You are gay" part, but even if it isn't, I still thought it was slightly funny that someone made the program trash talk it's creator. -- The day after tomorrow. Where will you be? |
