Where Chairman Powell could find himself between a rock and a hard place, if one were to view broadband as referring to high speed internet service, is the FCC position that broadband internet service (specifically cable internet) is not a telecommunications service. It would be interesting to see a legal opinion regarding the effect of this ruling on potential municipal offerings which do not contain a component currently viewed by the FCC as telecommunications.
