Pay Pal $9.25 million Settlement

If you opened an account at paypal between October 1999 and January 2004 you may be entitled to a payment from a class action settlement in California in July.

Even if you do not qualify as a dispute resolution claimant you still will qualify as a statutory damage fund claimant if you opened a Pay Pal account during this time period.

I'm glad to see that paypal is being forced to clean up its act and pay punitive damages to all who have been hurt by paypal.

I got an email that appeared legit but it didn't mention and settlement that had been reached (or maybe I didn't read that far). Anyhow it looked very much like any other class-action suit document.

The settlement website is legit. When you click on it from the email (or type it in your address bar to be really safe) you first reach »https://www.paypal.com/settlement/ and there is a notice explaining that you will be redirected to the settlement site.

EVERYONE who opened a Pay Pal account between the dates I listed in my first post is eligible to receive a check from the statutory damage fund. You do NOT need to have had a problem with you Pay Pal account in order to receive a payment from this damage fund. The form you fill out only asks for your name, address, phone number and the approximate date you opened the Pay Pal account. It doesn't ask for anything else. You must affirm that you did actually open an account during this period. That is it.

You will receive a check (minus $1 for processing) deposited into your Pay Pal account and if you have no current account then the check will be mailed to your home address. The amount will be determined by the number of claimants. There is $1 million in the fund and it will be divided equally among the valid claimants.

If you can show that certain problems occured with your account then you fall in a different category and may receive a substantial settlement amount.

Hi Mele - there's probably an easy way to determine when one opened one's paypal account - if memory doesn't serve? Right?

I would think paypal has records. I don't have an account now with them yet I got the email because I'm in their records. I had an account in Oct-Nov 2003 and way back in 1999 or 2000 also briefly. The form you fill out just asks for an "approximate" date so I assume that your submissal will be checked against paypal records. Their records may not be totally accurate though so if you have a print out of your account or something that could be verification if you submit a claim and it is rejected because Pay Pal's records are perhaps not complete.

Is that what you were asking?

If you have a paypal account, just click the History link and under the advanced options tell it to list all transactions from 1999 to the present. That's how I found out that I opened my account in 2000.

Thank you ctrip & Mele! It's mom who's got the account. She's probably received the e-mail as well. Hope she didn't delete it which is her normal response to unsolicited paypal e-mail.

She doesn't need the email. She should just go to the web settlement site shown in my first post and she can read the contents of the email there and there is a long FAQ also. Or the Slashdot site listed in my second post has a full copy of the email and a large number of comments about this.

You may be entitled to a payment, may being the operative word. You are eligible if:

You experienced an unauthorized or incorrect electronic transfer to or from your paypal account;

Your paypal account was improperly restricted or access was improperly limited;

You requested information from paypal about an account restriction or limitation or unauthorized transfer and you did not receive a satisfactory response; and/or

You experienced or reported an unsatisfactory result from a dispute with paypal involving a chargeback, a refund, a buyer complaint, or paypal’s Seller Protection Policy, Buyer Complaint Process and/or Buyer Protection Policy.

So its not a free for all. You need to meet certain criteria to be eligible to a claim.

You are correct TheJoker See Profile it isn't a free for all.
Even the statutory damage fund has a $1 million ceiling and all claims will be divided up equally, minus a $1.
That ought to net everyone about .02.

I think that's where the statutory damage fund form comes in, it appears that the only requirement is you opened a Pay Pal account during this time period (October 1999 and January 2004)and don't qualify for the dispute resolution claim. Even then, that has a ceiling of 1 million so the payout is virtually nil.

Yep. One Million isn't much unless most people eligible think they are not eligible because they have heard thus and so about it but never went to the site and checked for themselves so they don't file a claim. I hope most everyone doesn't understand the statutory damage portion of the settlement. Leaves more money for me that way!:) Hmm....maybe I shouldn't have made this thread...keep everyone in the dark and I might get a buck or two!

Just a thanks. This was the first place I thought of to check to see if this was a scam.

PS - Most I ever got from one of these class actions things was about $10. Lawyers on the other hand...

Not only did they freeze my account, but locked it once, double billed it, refused to give me the new password, and I still don't have access.

I had to reopen a new account, for the time being (until I could find a new provider).

Wow! That is terrible. You are definitely in the catagory of a dispute resolution claimant. You should get a reasonable settlement (depending on the number of valid claimants but the amount of money to be divided is much larger than for the statutory damages section). The kind of thing that happened to you is why these lawsuits (that were later merged) were filed. The statutory damage part is punitive and won't make anyone rich. Neither will a successful claim under the dispute resolution section but you stand to be reasonably compensated for all the "pain and suffering" paypal has inflicted.

I would urge you to file the long form claim. It is more paperwork but you will be eligible to receive more compensation. If you file the short form you will get $50. With the long form, the more damage you can show the more you are likely to receive a more equitible compensation.

From the FAQ at the settlement web site for a Dispute Resolution Claim:

If you make a valid Short Form Claim, you will receive a payment of $50. If you make a Long Form Claim, you will have the opportunity to provide documentation in support of your claim and thus may be able to receive a larger amount. Both the Long Form Claim Form and the Short Form Claim Form requires you to provide certain identifying information and sign a statement under penalty of perjury authenticating your claim, which may be subject to verification by paypal's records. The amount paid out for Long Form and Short Form claims will depend on the number of claims received and the aggregate amount of such claims. For more details, review the Plan of Allocation.

The long form, unlike the other forms, must be printed out and signed and sworn to and mailed along with any documentation you have to the Claims Administrator.

Blah. I don't qualify. I opened my account in the correct time range, mostly to buy stuff on Ebay but I haven't used it yet.

I wanted a new PC but I believe I can get a better one built by the people who build them here on BBR, and some of them do accept paypal. Just not ready to buy one yet until a game comes out I need to upgrade for. Which shouldn't be long.
