 ropeguruPremium join:2001-01-25 Mechanicsville, VA | Cavalier and the MPAA I just got a call from the wife that Cavalier has called and reported that I was housing Star Trek movies, per Columbia, and they had to turn off my DSL. No chance to correct the problem or anything BEFORE turning the DSL off.
First of all, let me say that I do NOT have any Star Trek movies or TV shows on ANY of my computers. I don't even watch Star Trek anymore. Way too busy with my work in the IT field. I don't believe in using Kazaa or any other P2P software with the exception of Bittorrent occassionally to download Linux distros or other legitimate software.
I called and the tech support rep was nice and understanding. She stated she would make a note on my account and have the person that handles all of this send me an email tomorrow with all the detailed information. Of course, this was after trying to get through to them for over 20 minutes because their front end auto attendant system would not pick up and would go to a fast busy signal.
Anyone else have any dealings with Cavalier over this. It really kind of pissed me off. I am trying to think of a way to take the MPAA to small claims court just to make them have to show up here in Richmond. I take this as slander from the MPAA that they are calling me a thief when they NOTHING to properly back it up. |

I woulda thought Cavtel would be under the radar, since there maybe what...5,000 users? I dunno, but not nearly the same amount as Comcast or Verizon, and definitely not the same amount of bandwidth usage. (shameless jab at our ReachDSL speeds.)

Once I have the info tomorrow about the filename, date they say it was on my system and everything else, I will look in my Astaro Firewall logs and see when, or if, they attempted to break into my network.
Me thinks they are randomly picking IP addresses to send to ISP's to make the numbers look over inflated. |

What the 'dogg says is correct: you are Cav's customer, you make their business viable and they are in a "partnership", of a sort, with you and their other customers. To do the bidding of a copyright holder just because the copyright holder says so & compromise the relationship with their customer base is wrong-headed. They should get that message loud & clear from customers who suffer service interruptions just because some copyright holder made an accusation. Hell, I could serve your ISP a letter saying IP#_._._._ misused my licensed material.
I'm glad they quickly restored your service, but still - that they altered your service at all ought to result in some pain for them as it's the wrong reaction to an allegation from some copyright holder. |

 1 edit | I do know that someone else was informed about having movies on their HD and was turned off. Same deal, called in, got the info on what files they were talking about. They did have the files and just removed anything MPAA might be looking for from their upload folder. Service was resored pretty quickly. |

This is regarding the report of file sharing that was sent to us from Columbia Pictures. The only information we receive is an email containing the date, time, and ip along with the name of the file being shared. I then search our database for who the IP belongs to. The IP address quoted in Bryan's email isn't even my IP address. I have never had that IP address. So obviously Cavalier's database is incorrect. I also had asked for all the detailed information in Which Columbia Pictures had provided, such as filename and time and date in which they saw the file. None of this was provided as requested. After reading this I responded to Bryan with the following:

So because Cavalier cannot keep their database straight, you took my line down and have accused me of stealing copyrighted material that I do not have and never will have. I take pride in my home network and even use a commercial grade firewall to keep out hackers and viruses.
To this I expect a written apology written on Cavalier letterhead and proof that your database has been correct so that this will NEVER happen again. I also suggest that Cavalier conduct an audit of their database to verify that all of your IP to customer information is correct BEFORE accusing someone else falsely and turning off their DSL connection.

I figured Cavalier at least owed me a letter of apology for turning off my connection before even giving me a chance to redeem myself. Also, if they would have given all of the info during the telephone call this would have been avoided in the first place.

No mention of sending a letter or even acknowledging reading my request other than updating their database with my correct information.
If there is anyone out there that can provide me with good email addresses via IM to Cavalier Telephone I would appreciate it. I want to send this as high as I can get it. If I cannot get the response I want I will go to Cavalier's home office which is located here in Richmond, VA and make a personal visit demanding to talk to someone. I will also take this to the local newspapers and TV stations and do my best to make life miserable for Cavalier. I should also mention I will do what I can to hold back any requests Cavalier has in with the Virginia State Corporation Commission as I legitimately can.
With this they have completly pissed me off when they could have easily corrected the situation with a proper written letter of apology and proff that this will not happen again.

As you should, escalate this crap beyond first level lackeys because it's pathetic that they wouldn't even lift a finger to investigate initially.

Meanwhile, if this is the way Cavalier is going to treat their customers, I will be looking for a new provider once I move. Hell, I will even think about going back to cable before I choose them again. |
