Not spyware to you then, but possibly malware/spyware to others as according to the description it can be "installed without any notice or consent whatsoever". If you install it purposely, its not malware to you, but when it installs for some others without any notice or consent, that's malware to them, as they have uninvited internet enabled software and have to spend time removing it.
