 How the hell is Spyware/Adware still legal?!?

How the hell is Spyware/Adware still legal?!? They are installing software on my PC without my knowledge or permission. I see no difference between a company secretly installing spyware on a user's PC to get info, and a hacker breaking into a user's PC to steal information and install trojans for his own use. They are exactly the same behaviour, yet one is illegal while the other is not. How screwed up is that?!?
