If the facts of the case as reported by AP are correct and the teenager was selling the downloaded stolen material than I think he got off pretty easy. But it is a nice warning for others that this isn't just about copyright infringement, but about theft of service.

Even though the US Court system has forgotten that the 1992 audio home recording act allows for the copying of media that you personally own, under the premise that you do NOT re-sell it. | reply to TKJunkMail I find it hard to justify a criminal conviction on this sort of thing. Remember people this is copyright infringement we're talking about. Not grand theft. Even though copyright law and the NET act makes concessions to move from civil to criminal there isn't enough information on exactly how much he sold for me to say this is justifiable (at least the jail timem... even if it was deferred). |

| reply to SRFireside I agree there is nowhere near enough information for us to form an opinion. When I make a copy of a movie or album for a friend, I usually get money for the blank media that was used. Technically, I'm selling (not profiting) a copyrighted work.
We don't know if he was bootlegging for profit or not. With them letting him off this easy, I'm guessing he wasn't profiting from the sales. |

| reply to King P Actually copyright doesn't allow you to just give the copies to anyone you want. What it allows is that you can make a backup copy of media that you own but if you give away or sell the original, the copy must go with it or be destroyed. -- I am of the stars. | Technically copyright law doesn't specify this either. As a matter of fact copyright law's only "claim to fame" regarding sharing music is the term "sales and distribution". While this person obviously violated copyright law I still question the validity of the RIAA's other claims. |
