The only argument I've got against the "they're actually regulating the internet but they say they're not" idea is that they are not regulating VoIP service that operates solely over the internet. Instead they are regulating that VoIP service which interfaces with the PSTN network and uses numbers that are issued for use with the PSTN network.
That's my understanding anyway.
