Domain Name and how not to get sued

I want to register a christian domain name however it has only one word before the domain name of a popular company. Should I worry about getting sued? What if I were to let people know staight up I'm not affialted with that company. Thanks

I doubt you will get sued right off the bat. Most likely a letter from the "popular company" advising you to cease and desist using their name. Then the lawsuit if you fail to comply.

As long as your christian domain isn't "Microsofl.com" you should be OK.

actually it's going to be something like christianebay.com
although ebay will not be the name of the company.

Most companies are pretty aggressive about protecting trademarks. If a company name is embedded within a domain name most likely they will try and get you to change it. It all hinges on the possibility of "confusion." In addition with the proliferation of Pfishing attacks companies are extra wary of similar sounding domains.

Well, in 2001 eBay sued BidBay for just the "bay" in their name. Also, doesn't Jesus have a trademark on his name too.

the ebay part will get you sued, or threatened with legal activity.

Do something creative. "Jehova's Market" or "Jesus's Liquor Store" or "Allah's Auctions" or something like that.

haha nice ones!

ChristianEbay or any combination with another auction site would infer that you are affiliated with them.
It would suck to get everything set up and then receive a cease and desist and have to start over.

I would play it a little safer.

Well, I own the domain name crosswalkhosting.com I don't think crosswalk will try to sue me, lol. It's not my fault they have a cool name and don't do hosting, lol. Anyway, when I make my site live I'll be sure to let everyone know that I'm not affiliated with them. I'm so sick of places like christianhosting.com screwing people because they don't know any better! I want to give Christians and everyone else a fair shake while making a living

So you feel that using another company's name is a fair shake?

I doubt Jesus would want you to imply an affiliation with ebay by default (since technically, your implication is that you are a christian version of ebay per your domain name).

You can bet that their lawyers will have a field day with this one. I'll be sure to forward this topic to them so they can be on the lookout.

There will not be a judge on the planet that will believe that the registered owner of this domain had every intent not to steal brand-name recognition from eBay.

Shows complete lack of creativity or original thought on the matter. Hope you have tp, because they will bend you over.

It's all a bit more complicated than that. (Disclaimer: I'm not a lawyer. This is not legal advice).

To ask for trouble is to use a trademarked name in your URL. You are fairly safe if you use a common English word, AND are not in a similar business as an existing company holding a trademark.

Example: You register Bigtower.com, and decide to sell music CD's. You may then be confused to be Tower Records, an existing music retailer. If you were in the business of erecting communication towers, you would have little to worry about.

Using a non-English trademarked name in your URL may get you more attention than you want. A friend had registered Tatooine.com, where he ran a general discussion forum (not a Star Wars fan site). It was active for several years, until Episode I came out. Then the lawyers for Lucas Films contacted him, threatening a lawsuit. Even though he may have won a legal proceeding, how do you compete with the deep pockets of George Lucas? He decided to accept the agreement that they worked out.

I think that's a safe one - and they'll probably get lots of visits from known BBR perverts members.

As for using a similar name, it can go both ways. Take ZipZoomFly.com - they started out as GoogleGear.com and Google.com took exception. Guess who won the battle.

Crosswalkhosting should be fine if you don't mention christians/christian hosting in any way. Keep in mind, a crosswalk is not a christian word. A crosswalk is a place where pedestrians cross the road! Attached here, is a picture of a croswalk; I just want to show you people who are on Crosswalk.com's side. I am not taking sides of anyone here, but some of the posters here are getting out of hand, blaming someone for using a normal english word, such as Crosswalk for copyright infringement.
