Looks like askmrauto See Profile went into business without doing any research to find out if the name in question could violate any existing trademark, and then blames it on them when they attempt to enforce that trademark.

Trademarks must be actively enforced, otherwise they lose their effectiveness and the owner could lose legal claim.

Pointing your finger at others and saying `But they're doing it too' doesn't really help you out in this situation. You registered a domain name so similar to an established websites name that they contacted you with a `cease and desist' request.

What does that have to do with it? Just because you trademark a domain does not mean you can stop someone from using the same name for something totally different that you don't offer.

Sorry! Crosswalk is a plain English word, not one that is made up! If they wanted exclusive rights the "holy" people at crosswalk.com should not have been so dumb!

Yes, but Salem Web Solutions does operate in the same market you are trying to get into. Those other sites you linked to with "crosswalk" in the name don't.

Being cocky about it doesn't help either. I know myself I wouldn't do business with you simply based on your attitude.

They do have exclusive rights to the domain crosswalk.com. They have several registered trademarks. If you don't understand how that works, might I suggest you read up on how it works.

I can read just fine, and No, it has nothing to do with webhosting...it's directly related to the trademark issue. I don't really care what sort of services you're offering (and your credibility as a webhost is rapidly deteriorating).

BUT...if you really want to talk about who offers hosting and who doesn't, we can. Try registering microsofthosting.com or googlehosting.com. Maybe dslreportshosting.com. None of them provide webhosting but I'll guarantee that you get a letter from them as well.

Bottom line: It doesn't matter. You are piggybacking on their name. You showed premedetation to do so and were advised not to by several members and you got caught.

No, actually I want to start a legit business helping both Christians and Non-Christians AS far as pissing them off goes they pissed me off! Yeah, we are Christians, haha! They could have easily introduced themselves the proper way like anybody else. Instead they choose to be the company that they really are.

A bunch of clever marketers who could care less about Christians and from the notice they sent me it only becomes more apparent!

You're sidestepping the issue when you attempt to turn this into a "Christian" thing.

Religious affiliation doesn't matter here.
How they run their business doesn't matter here.
Who owns legal rights to the trademarked name does matter here.
How you treat others does matter here.

All of these things reflect poorly on your professionalism and credibility. If all you really wanted to do was offer web hosting, you'd have chosen another name and be done with it.

With domain names being so cheap, and the fact that he hasn't had time to build any real name recognition at this point it would make much more sense to move on instead of making a spectacle of the issue in a very public forum and on his homepage.

Now they're sleazy? Because they sent you a very politically correct letter informing you of the trademark violation? In business, you must protect your assets which includes your name.

It is a neat sounding domain name, I'll give you that. They think so too, in fact so much that they trademarked it.

After reading this post, I can't but help wondering if you didn't have other intentions when registering your domain....like say, trying to sell it to them?

I was thinking that after they sent me the nasty gram! Secondly, I want nothing to do with their company! They had their chance and ruined it with a nasty gram. If they were so interested maybe they good have written a nice letter. Far as assets go. If they don't have enough so they are worried about me using crosswalkhosting.com to start my own web hosting company then they really need to think about how they screwed real Christians! Hmm, but that never comes up?

O'well I'm done wasting my breath! Obviously you people are not Christians and don't realize what a crumby thing they did to www.crosswalk.com.

Legal issues aside, you shouldn't let anyone railroad you; however, you lose all credibility when you refer to the company in this thread as:

"sleezy portal company"

and then suggest in your other thread »Can this be true? and on your website:

"I told him instead of threating me, would it not be smarter to partner?"

"Why not partner with me and help each other out?"

Religious beliefs don't pay the bills and are irrelevant to this discussion. Just because you share the same faith doesn't give you the right to infringe upon a name they've invested in.

They could have been potential partners but after they RR me that is not going to happen! They can still be a sleazy portal company and clever marketers. That is proven when the bought out the real www.crosswalk.com instead of offering to help them.

"Why not partner with me and help each other out?" was referring to they could have offered me the choice and wrote me a nice letter instead of coming off like a nasty company right off the bat. However, I'm glad I found out what I did because after reading it, it saved me from making a bad mistake!

Why did I take crosswalkhosting.com because it is a perfect name for a hosting company. If they were interested in doing hosting in the future they could have taken it. Or offered to buy it from me? You will notice on my website I clearly state I'm not affiliated with them, nor want to be after the way they threaten people.

Lastly, faith has all to do with? Do you read the bible? Do you even know famous quotes like "turn the other cheek", "forgiving you brother", "not getting involved in earthly things, etc." This discussion would have never came up if Salem helped them out instead of helping them bail out!

Anymore questions? Or can we put this to rest Johnny 5?
