| [News] Victim countersues RIAA under RICO Act
One of the victims of the RIAA's sue 'em all campaign, Tanya Anderson, has filed a countersuit under Oregon's RICO (Racketeering Influenced Corrupt Organization) Act, as well as for fraud, invasion of privacy, abuse of due process, electronic tresspass, violations of the Computer Fraud and Abuse Act, and other allegations:

Anderson, who is disabled, lives alone with her 8 year old daughter. The two exist on government disability payments.
What with this and other stories about victims fighting back, and RIAA lawyers running like rats when it is shown their charges are bogus, it appears to be the beginning of the end for the music cartel's extortion campaign against filesharers. -- "Kayura or Badamon, whichever you are, you should know that I will never give up this battle. By the will of the Ancient, I shall succeed!" - Shuten (Anubis) from the Ronin Warriors. To RIAA/MPAA - You can sue but you can't catch everyone! |

| i just read that on Slashdot.org. I thought this part was pretty funny:
11. Settlement Support Center also falsely claimed that Ms. Andersen had been viewed by MediaSentry downloading gangster rap music at 4:24 a.m. Settlement Support Center also falsely claimed that Ms. Andersen had used the login name gotenkito@kazaa.com. Ms. Andersen does not like gangster rap, does not recognize the name gotenkito, is not awake at 4:24 a.m. and has never downloaded music. -- nfx |

Only time will tell, but the very act of filing against the MPAA under RICO statutes has already created a precedent that will change the landscape of the court challenges forever. |

| I do believe I know how it could've occurred. No real proof, but it states she has Verizon. If she got it recently enough, it comes with a wireless modem. Had the antenna been on (or off), the wireless is on without any security (WEP/WPA) turned on. So someone could've easily logged into her wireless network and downloaded rap at 4:24. Not hard, I've tested it with my own router (now locked down). It's free and clear from first setup. -- The one, the only, the Insder. :: Verizon Online DSL (2793/719) and Deer Alpha Firefox! |
