I suspect that the RIAA won't even try to get a criminal prosecution. That would require a criminal complaint in a court competent to handle the case, and attendant publicity. Their tactics seem to be to create an atmosphere of uncertainty; which seems to be working very well.

I have only download music twice; once under a licensed agreement, once of an album which isn't in print, and not available anywhere that I can find. If I ever do locate a physical copy, I will buy it. It was anime show tunes for a T.V. series. I didn't use a P2P program for those .mp3 files; they were hosted on a French web site.

I do use BitTornado for anime shows. I get the fansubs. I think that they fall in a gray area; the shows are under copyright, but I don't know how serious the Japanese owners would be about enforcing their rights in the U.S. courts over the shows. It may be that they calculate the cost of enforcement as exceeding any perceived loss, or something else. The sources I use stop distribution as soon as the shows are licensed for U.S. release; and, in any case, the ones which catch my eye are on my "to buy" list, anyway.

I won't touch any shows clearly under U.S. license. If they are good enough to watch, I will pay to watch. If they are not good enough to watch, they are not good enough to risk the wrath of the RIAA/MPAA.

Your friend's son is probably not a likely target for RIAA/MPAA action. But that doesn't change the ethics of taking that which is being offered for a fee, and not paying the fee to obtain it.

While I agree I find it highly unlikely the RIAA would ever get a conviction of someone who merely downloads copyrighted materials. I know there is theft by receiving however that tends to be what you see in criminal courts and not the civil court structure.

I have a friend who's son downloads using a Bittorrent client and also uses Limewire. With Bittorrent he typically only downloads, I presume legal, Anime movies but downloads music using Limewire. He shares his Anime movies but doesn't share the music he downloads. I was thinking he might be kind of safe using that method since he is not sharing the most likely illegal songs he has downloaded.

Sort of like the difference between stealing stereos (uploading) and buying stolen stereos (downloading)?

Copyrighted material can only be published with permission of the copyright holder. Acquiring copies of copyrighted material from sources other than authorized publishers is just as wrong as publishing without authorization. It is, generally, more productive to go after the publishers; but that is not a limitation of the statutes covering copyright.

i stopped downloading movies on edonkey because of a letter way back in october two years ago. it's strange that the date of the letter was actually almost a month after the time of th e 'infraction' on my part. I wonder if that's sped up at all.

I like my Beretta M-96 a lot more than any movie which isn't worth the $20 to see in the theater. I'll stay in the U.S., thank you. And I won't waste time downloading silly copyrighted movies not worth paying to see in the theaters. (And pay to see, if it is worth it, instead of downloading it!)

Well at least you have the option to stop or risk litigation. I would be ever so pissed if I ever get a notice in the mail saying I am being sued by MPAA/RIAA. Honestly if I ever received something saying stop or else, then I would probably stop. Or if nothing else just lie low for a while.

So.... I have a choice. Either I never share again or I never download again. Since I'm faily new to Bitlord, I guess I will just quit downloading until I figure out how to turn sharing off.
