Well, that's exactly the problem with Verizon's advertising. They could advertise all the restrictions right in potential customers' faces, but do you honestly think that they would sign up as many people for limited service as they would for unlimited one. As long as your usage of the service remains within the TOS, you can use the service as much as you want with impunity.
Use the service outside of the TOS the usage is no longer unlimited.
Why is that so hard?

P.S. It's no different than unlimited mileage for a car rental. The TOS for the rental car details what the car can be used for and where it can be used. If you don't abide by those rules, the mileage is not unlimted. -- It is impossible to create an idiot-proof product. Humanity is simply too adept at churning out better idiots. |

Reading the TOS you can only send / receive email and browse the web. So with that said should the advertisement be for web and email access because you aren't getting "broad band access". You are getting speedy access to web pages and email.
How ever you slice it they are taking the customer for a ride. |

That means WITHOUT the Customer Agreement, there is no service.
B) So what does the Customer Agreement state? quote: Unlimited NationalAccess/BroadbandAccess: Subject to VZAccess Acceptable Use Policy, available on www.verizonwireless.com. NationalAccess and BroadbandAccess data sessions may be used with wireless devices for the following purposes: (i) Internet browsing; (ii) email; and (iii) intranet access (including access to corporate intranets, email and individual productivity applications like customer relationship management, sales force and field service automation). Unlimited NationalAccess/BroadbandAccess services cannot be used (1) for uploading, downloading or streaming of movies, music or games, (2) with server devices or with host computer applications, including, but not limited to, Web camera posts or broadcasts, automatic data feeds, Voice over IP (VoIP), automated machine-to-machine connections, or peer-to-peer (P2P) file sharing, or (3) as a substitute or backup for private lines or dedicated data connections. NationalAccess/BroadbandAccess is for individual use only and is not for resale. We reserve right to limit throughput or amount of data transferred, deny or terminate service, without notice, to anyone we believe is using NationalAccess or BroadbandAccess in any manner prohibited above or whose usage adversely impacts our network or service levels. The cancellation letter was sent to someone who, by his own admission, was using the service in a manner inconsistent with the terms and conditions of the service. As long as you remain within the terms of the agreement, the usage is unlimited. It's not hard to grasp.

Though in the scenario you've offered, any car-rental advertisements will specify unlimited mileage and nothing else. So any potential customer wouldn't necessarily expect to drive on the wrong side of the road at 200mph. 
Verizon, in its advertising its EVDO service as simply "unlimited," is implying that the things one would normally do with a standard internet connection (watch movies, download/play games, stream videos, etc.) would be available in a similarly unlimited capacity via EVDO.
Now if VZ said "Unlimited Minutes" or "Unlimited Connection Time" or "Unlimited e-mail transfers" or something to that effect, then it'd be a different story. Correct me if I'm wrong, but I don't even think that their commercials even have the standard "fine print" that car ads or drug ads do. -- Copyright infringement is illegal. Murder is illegal. Therefore, file sharing is murder. |
