The Stanaphone announcement says "Says Michael Choupak, president of StanaPhone Communications LLC, This announcement represents our unambiguous pledge that we are not an interconnected VOIP provider as defined by the FCC (FCC-05-116A1, paragraph 24) and that we are not subject to the November 28 FCC 911 requirement.
If you read FCC-05-116A1, paragraph 24 it says
24. telephone calls that originate on the PSTN and can be used to terminate calls to the PSTN interconnected VoIP services. Although the Commission has not adopted a formal definition of VoIP, we use the term The E911 rules the Commission adopts today apply to those VoIP services that can be used to receive generally to include any IP-enabled services offering real-time, multidirectional voice functionality, including, but not limited to, services that mimic traditional telephony. Thus, an interconnected VoIP service is one we define for purposes of the present Order as bearing the following characteristics: (1) the service enables real-time, two-way voice communications; (2) the service requires a broadband connection from the users location; (3) the service requires IP-compatible CPE; and (4) the service offering permits users generally to receive calls that originate on the PSTN and to terminate calls to the PSTN. We make no findings today regarding whether a VoIP service that is interconnected with the PSTN should be classified as a telecommunications service or an information service under the Act.

It looks like Stanaphone is claiming that because "Stana-IN" and "Stana-OUT" are separate optional services, they don't fall under the definition. That would be true *if* Stanaphone did not allow both options to be applied to an account simultaneously.
But, since they *do* allow an account to sign up for both, I believe the FCC (and reasonable persons reading the definition that hwittenb highlighted for us) will find that Stanaphone *is* an interconnected VoIP provider to those accounts and thus required to adhere to the E911 rules.
I hope they're prepared for the NoV and subsequent forfeiture. |
