[Extreme] rogers kills bittorrent

Well, over the last 24 hours all of my bittorrent sessions have fallen to a meager 0~1.5kbps/sec. I just got off the phone with Rogers and they admitted that they are completely throttling bittorrent on their network.

I guess I shouldn't have signed that 2 year contract... should I leave them and take the penalties or wait to see if this BS passes?

I have no interest in Broadband without P2P

Actually, you can call them back, and if you signed up PRIOR to them throttling BT, then you can cancel out of your contract...

Go on about "It's not the service I originally signed up for", and tossing in how you need Usenet probably won't hurt either. Worked for a friend of mine who was stuck in a one year contract.

What client are you using? set your client to use listen port 1720 and you should be fine.

Well that's interesting. I'm getting adequate transfer speeds after switching to 1720. This port is typically used for H.323... videoconferencing protocol. Hmmm... so it looks like they are throttling ports (and maybe # of active connections). So until they can filter at the application layer... interesting. Hey, I'm a satisfied customer again.

So, I would say they have customers using videoconferencing on their network and they need to garantee QOS for that app. And they need to still give them multiple sessions. Wow!

Yes, I also got that problem just at yesterday! Anyone got that slow download problem, please reply. I live in Richmond Hill area.

down: 2kb/s, up: 10kb/s (was 60kb/s, up: 20kb/s), 1720 port, header encrypt always on. So now got a 50mb file needs a whole day.

eMule:
almost no one on my queue list, (you know for eMule, no upload = no download), program keeps looking for servers again and again. For the whole night, I could not even get only 1 mb, what the f...

Man that really sucks! That happened I believe was at July and now it happens again. Guess it's time to use Bell. If I cannot use high speed for downloading, why do I need that? Everyone just go back for phone modem for only web browsing and slow downloading.

I dont see any legal reasion on how rogers can get away with this Sh*T. yes some may say the EUA but the way i see it is they are over useing there power and thats NOT right.

Then take Rogers to court.... Oh wait you gave up that right by agreeing to the EULA. I suppose you could take them to court to try and win the right to take them to court....

Beverley Reade's lawsuit has struck a nerve with angry Internet users.

Beverley Reade's celebrated lawsuit against Rogers Cablesystems Ltd. has turned the Ontario judge into an overnight heroine for hundreds of citizens upset with what they call the company's faulty Internet product and its feeble customer service.

Judge Reade, a single mother and small claims adjudicator in London says she has been inundated with phone calls and e-mails from disgruntled Rogers customers since news of her lawsuit was published in the National Post on Thursday.

The case is inspiring a variety of offers: a large Toronto law firm wants to give Judge Reade a job; people have volunteered to help fund her lawsuit; and old boyfriends have begun to call.

Yesterday, Star Choice Communications, one of Rogers' chief competitors, also seized a perfect public relations opportunity by installing a free satellite television dish at Judge Reade's London home after learning that she had cut her Rogers cable account in disgust.

"The newspaper article said her kids had gone without television for a while, so we thought we would help her out," said Gillian Harrison, a Star Choice spokeswoman.

Replies Taanta Gupta, Rogers' media relations director: "It was most unfortunate that we lost a client."

Judge Reade is suing Rogers in small claims court for $5,800 in damages for what she calls the company's "high-handed, contemptuous behaviour."

Her lawsuit says Rogers failed to deliver on its assurances of easy, high-speed Internet access after she signed up for the service in 1998. When the system proved to be faulty, Judge Reade spent hours seeking help from the company's customer service reps.

When Rogers failed to send Judge Reade a credit for poor service, she refused to keep paying her Internet bill. And when Rogers sent a collection agency after her -- whose agents, she says, threatened to sue her and ruin her credit rating -- she launched her own lawsuit in small claims court.

Judge Reade's friends now call her Bev 'Brockovich.' And her stance against a cable conglomerate has prompted others to come forward with tales of frustration.

"I've been getting e-mails, and people are calling and offering me money if I need it for my suit," she says. "Rogers is deceiving itself if it thinks people out there are happy [with its service]."

Some have even asked if they could join Judge Reade in her case against Rogers.

"I've got a Rogers file an inch thick with letters of complaint," says Bill Adamson, a 70-year-old cable subscriber in Toronto. "I'd love to go to court with the young lady."

Adds Stefan Kanitz, a Toronto businessman: "That company needs to have a good corporate spanking. Their practices are just awful. I would be one of the first to sign onto a class-action lawsuit, or to walk into Judge Reade's door."

Judge Reade is no longer a practising litigator, and therefore has no plans to lead her own class action. However, Teplitsky, Colson, a respected Toronto law firm, is investigating the merits of launching a class-action case.

"I've had people talking about this and urging me to bring the claim," says Colin Stevenson, a Teplitsky lawyer. "There's been widespread complaints of inadequacy of service."

Mr. Stevenson says any class action would argue the company had breached its contracts with Rogers@Home Internet customers by failing to provide the level of service advertised. He said the class action would not be likely if Rogers has paid credits to customers in lieu of poor service.

Judge Reade, who never received such a credit, says she will settle her claim against Rogers for an undisclosed sum of cash and a letter of apology from Ted Rogers, the Toronto cable TV mogul.

After her lawsuit became public this week, John Tory, chief executive of Rogers Cable, tried to phone Judge Reade with a personal apology. He has also offered to deliver an apology from Mr. Rogers on Monday.

Judge Reade says it would be improper for her to speak to Mr. Tory since she is suing his company, but if Rogers' lawyer wants to call with both an apology and a cash offer, then she says she'll listen.

"I do appreciate the apology. I think it was very nice for him to call me," says Judge Reade. "But I want the whole settlement."

Your talking about something that happened in 1998 and was settled in June 2002. The judge didn't take Rogers to court. She used arbitration like the EULA offers.

Use Bitcomet and make sure you enable Protocol Header Encryption in options. That's the only thing that works for me. Port 1720 makes no difference here.

so then maybe us users should all Get together one day if you cant come do a Conference call with the others and find a way to work with in arbitration with rogers and if the arbitration don't work then it can go to court.

And in all of this, Rogers then has the right to not serve you as a customer. So, you lose.

*sigh* Don't want to sound like an apologist for Rogers (since I dislike throttling just as much as the next person) but really hate the fact that people can't see the bigger picture of why they have to throttle (money+network inabilitiy to cope with what users are doing to it; AKA flooding the upstream).

And yes, the EUA protects Rogers so they can ensure the other 99% of users get a better service opposed to letting the P2P users abuse all the bandwith. Last night I got a file off downloads.com at near 760 kb/s...so throttling can't be all that bad if it's ensuring I can get my files as fast as possible.

Again, don't want to sound like an apologist for them, but can see where they're coming from.

Hey Bender ... the problem isn't the throttling ... if BT speeds down dropped from say 5Mbps to 2.5Mbps or even 1Mbps, people wouldn't be screaming so loud, but the current throttling is reducing download speeds to DIALUP speeds or less!

Do they really need to throttle P2P *that* much? I doubt it.

True, and can't argue that it's not excessive and that they're going about it the wrong way, but can still see the reasoning (it's a business of course, and they make big savings in the long run by scaring away P2P users).

Zero tolerance I don't like as a solution of course but what can we do...
