After reading many of the forums here about speed caps, download caps, this cap, that cap, block this port and that port. All done without the knowledge of the customer until after the fact. That is until an end user violated some unspoken, undocumented, unaddressed issue in the TOS. I don't see TOS being a problem if a broadband provider decided to or not participate.

They'll just wave the invisible magic TOS wand and make it so.... so a end user can or can't do it.
