 Comcast Ordered to Issue Refunds

As a result of last year's rate review, you may be due a refund.

Comcast was ordered to issue a refund of $2.57 to customers in Montgomery County MD. The refund should appear on the March bill. Montgomery County's Executive Order is found here:

Was MCMD the only region to order a refund?

I wouldn't say we have 'em over a barrel here, by any stretch of the imagination. Keep in mind, this adjustment doesn't change the monthly fee - it's a one-time refund.

That doesn't help. I want a permanent roll-back.

Local ILEC is Sprint. They are still up and down about where they supply xDSL.

I'm getting real tempted to do Wildblue and DishNetwork Family.

I've talked to Guilford Township several times and get the same response every time. There is no "Franchise Agreement" with Comcast. I think Comcast just sent them a legal letter that the township acknowledged that they knew Comcast is in their jurisdiction and Comcast is calling that a "Franchise Agreement".

It probably won't get you a price decrease, but you could report Comcast to the FCC for operating without a franchise agreement.

Are you still paying $18.65, or has it gone up again?

As of March 2006, they're jacking me for another $1 per month to $19.65 for 22 channels.

Bucks county is getting a .35 increase to $12.85 and Lancaster is getting a $1 increase to $15.25

That seems ridiculous. I did notice that my local Expanded service (75 channels) is much lower ($26.30 to $28.10), while Bucks and Lancaster are $31.45 to $33.30 and $34.95 to $37.55 respectively.

Looks like I've been subsidizing the upper tiers.

Yes, it does look like you're subsidizing the upper tier. Are you at least subscribing to the upper tier?

As you know, Comcast isn't likely to lower the price of limited basic on their own. Even if you can get your franchise authority to admit to having an agreement with Comcast, they can't regulate Comcast's rate for limited basic unless they're certified by the FCC. Something tells me they wouldn't be willing to pursue certification.

I think you're screwed.

But send a letter to the FCC anyway. Might as well let the "powers that be" know what's up.

Just got back from the Township Supervisors Office and they confirmed (once again) that they don't have an agreement with Comcast and never will because they don't want to deal with them (or anyone else). No, I don't subscribe to the "Expanded Service" (formerly known as Standard). We did get digital on Monday. They have a promotion where the installation was free and the next 12 months are $9.95 for the "Plus" service. It also includes PPV & On-Demand.

On a side note:
I finally got around to finding the Fiber Node and "Walking" the line. I need to borrow a good digital camera with a zoom. The line has several areas where the trees are growing around the hard-line.

It's about 1.5 to 1.75 miles from me and includes:
1 Power Inserter
1 Line Tap
3 Main Amps
2 Line Extenders
4 2-Way Splitters
5 2-Port Taps
1 4-Port Tap
1 Equilizer

Before it reaches my 2-Port Line Tap (attached to the EQ), leaving only the End-Of-Line 2-Port Tap after me.

I forgot to mention that the Township Office told me that they have been after Comcast for a long time to get that "Franchise Authority" information removed from the bills.

Heh, I'm at the end of the line too.

I'd seriously consider sending a note to the FCC if I were you. That's a really wacky situation. If your locals won't exercise their authority to oversee the franchise, then the FCC should step in. They probably won't, but it doesn't hurt to ask.

the fcc doesn't care about cable anymore. They gave up control over cable companies when congress passed the telecom act of 1996. No telling if the new head of the FCC will retake control of cable companies with the pending buyout of adelphia by comcast and time warner though.

According to this document »www.umaine.edu/mcsc/mpr/Vol2No3/CTR.htm , consumers can file FCC Form 329 to complain about expanded basic rates. Curiously, the FCC does not have a copy of this form posted either here »www.fcc.gov/formpage.html or here »www.fcc.gov/Forms/ .

Even though your complaint is about limited basic, it might be worth pursuing with a 329 (if you can find one) anyway.

We're talking about up to $5.00 (or more) per Month for over four or five years for every "basic" subscriber in PA. I think you could call that "Over A Barrel."

Excellent find. The problem I see with the FCC ruling is the age old one that the CATV companies have always used about SatTV being a viable competition. Though I don't know how they can say that about "Basic" service.

Yes, I saw that. I still think you should file a 329 (if you can find one). Explain that you wish to complain about limited (not expanded) basic, and that you tried resolving your complaint with your local franchise authority, but they will not admit to being the franchise authority.
