How does this happen....

...when a single corporation, driven by green, can sue a town, of voters/elected members who democratically VOTED on a plan to improve their city.

If corporations can successfully squash government/citizen voted actions out in the open through the court systems, we are in trouble.

Clearly the town wants next gen. type fibre, BellSouth should get on the wagon and offer up some type of agreement to help or anything, instead of doing nothing but trying to suck the town dry. God forbid they have significant competition.

Because the state in which that town resides in passed a law in 2004 alleging to protect private telecommunications businesses from unfair government competition — called the Local Government Fair Competition Act .

Perhaps the local government should shoulder some of the blame for passing such a law. Does it make it right for cable & telco's to be able to sue? Who knows, its in the eye of the beholder.

law was passed by STATE after very serious politicing by BS. problem at this point is question of whether the LUS parent utility company can shoulder financial responsbility to improve bond rate. LUS lawyers and BS lawyers agree to disagree.
